Despite what most people assume and many more wish the Internet has become regulated. The Internet is controled within a countries borders resulting in many conflicting laws. That's a problem for Internet companies who have assets across many borders. Can they get away with just following their countries laws? Time and time again the authors evince the answer being no. Companies like yahoo, google, mircrosoft, ebay, the Dow Jones, obsequiously follow foreign laws but not necessarily sacrifice their own.

Some of these companies have no qualms either assisting the Chinese filter pro-democracy websites, in short because they feel they have to. As I right this Yahoo is being sued by the World Organization for Human Rights for giving the Chinese government I.P. addresses of Chinese citizens who will then jailed and tortured for subversion. Yahoo asserts they were simply following the law.

And that is the problem facing these companies especially with China. They really have no other choice to or get out.

The book was well writen, fair and balanced.

5 out of 5 stars Understand the complexity of the Internet.......2007-01-15

Jack and Tim made one thing dramatically clear: The Internet is no lawless enclave in our world. Their journey from the very beginning to the modern Internet is full of clear examples and anecdotes describing the "rude awakening" of idealists and patient people who participated in the development of the globe-consuming web.

When I read that the authors come from the dry plains of law science I was sceptical if the book would be worth to read. I imagined that their approach would be as dry as the 1000 ft law books in the libraries.

But, when I opened it and started reading I first put it down after page 186, the very last page of the remarkable work. Their writing is so gripping, so light to read, that even a none-English person like me could easily understand and enjoy it.

After working with the Internet since the beginnings of the 80's I thought I knew a lot about it and how it is screwed together, but I got surprised. Their view from a complete different angle, threw light on hidden aspects I honestly never thought about. In a modern world full of economical interests and its enforcement all makes absolute sense and even dramatic events like the Napster case fall into their logical place in this big puzzle.

Every part of the book is filled with cross-references and hints to further readings. All cases and examples are deep researched and very neutral presented.

Buy it, read it and give it to a dear one.

The title about China and other pointed questions in this excellent book are addressed with a perception rarely achieved. The thought processes that go into policy decisions effecting governments and individuals, a collectivism vs. individualism. The reader is easily made to understand complex technologies and issues, not only at their core but as they expand outward into the real world. From the internets architecture, bandwith, internet borders, copyright laws, crime and criminal law, domain names, eBay, economy and commerce on the internet,filesharing, globalization, and much more. Or questions such as, "How can it be harder to notice that information has become more difficult to find? It is hard, in other words, to know what you don't know." CENSORSHIP. Pick up this book. When you finally put it down, you be the one of the ones hitting their fast/curve balls out of the park.

5 out of 5 stars A great recounting of the history of the Internet and the future of its legal ramifications........2006-11-04

This book was required reading for a law school course on the Internet's legal issues. Aside from being one of the least expensive books I've ever been required to read, it is a great book that accurately addresses many of the relevant legal theories. One should note that while the authors do not claim to present a de facto statement of what the law is, there are significant factions of legal scholars who disagree with many of this book's conclusions, of whom my professor is one.

All in all, this is an excellent book for anyone wishing to better understand the way the Internet affects (or does not affect) legal rights without wading through 15 years of case law. Furthermore, the authors have written this book in a manner that makes easy to read and enjoy for the technically adept and the technically challenged (i.e. lawyers) alike.

This book is the best complete statement of the second wave of internet scholarship. If you ever thought that the net destroyed the significance of geography, or that cyberspace should be thought of as a real place, you owe it to yourself to see how things are really turning out.

I've always wanted to be a Lawyer practicing Internet related law so this book is just what I needed to bring back those old dreams. It's great as a class text because it's not too verbose and esoteric. You'll get a firm understanding about Internet Law issues and cases to further your understanding.

A truly useful and intriguing work, this book abandons the traditional division of topics along doctrinal lines and chooses to group the subjects according to the way they challenge our established beliefs. Therefore, the reader encounters a chapter on "Geography and Sovereignty" rather than "Jurisdiction" or "Individual Autonomy and Commercial Control" rather than "Copyright". This works well and constantly makes the reader rethink Cyberlaw. The cases and articles are relevant and carefully chosen. Essential work for students, highly recommended for others.

4 out of 5 stars Writing Effective E-Policies Is a Team Effort.......2005-07-12

Does your company or organization have a policy that covers writing style in electronic communications? Does your company or organization have cyberinsurance to cover losses attributed to errors or employee misbehavior using your e-mail systems? Does your company or organization offer netiquette training for employees and managers? These are topics that many do not think of but should and that are covered in detail in The ePolicy Handbook: Designing and Implementing Effective E-Mail, Internet and Software Policies by Nancy Flynn (256 pages ; The American Management Association, 2001). Though this book is a few years old, it is worthwhile for Human Resource managers and anyone else involved in the development of ePolicies for their company organization.

The book starts out by covering what every organization should do when deciding what kind of business controls to put in place: the conduct of a risk-assessment. This step is key to putting together a team, conducting a control self-assessment (the author refers to this as an audit, which really is the wrong term from a business controls perspective).

The second part of the book covers the establishment of over all ePolicies to limit liability and exposure. One of the key considerations here is the purchase of appropriate liability insurance. As the reader moves through the book, they will be walked through the steps to craft effective policies for the use of E-Mail. the Internet, and computer software (especially piracy issues). It is after this point where most readers will get perhaps the biggest surprise and guidance. Specifically, the reader will be walked through what steps are needed to truly make any written policies effective. This includes getting buy-in from all line managers, communication of the policies, training and following through. The reader will then be walked through the establishment of eWriting policies for employees, with the main point being that writing e-mail communications should follow the same rules and style of other written communication sent through snail mail. The book finishes up discussing how to respond to an eCrisis.

The book is a very easy read and can be a valuable resource. The only things I did not like about the book is that there are too many points repeated in the book and the fact that the book did not include a CD-ROM of samples from the book was not included. The repeated points may have been for emphasis, but to this reader often seemed to be space filler. The only other caution for potential readers is that the book, while providing good information and examples, seems to be a lead-in as a commercial for the services and her colleagues in and around Columbus, Ohio. I wish that had been a little less blatant than as presented in Appendix E.

This key to designing and implementing email and software policies in a company structure provides business owners and managers with important information on how to produce clear policies which regulate computer use. From workplace piracy to e-theft insurance, Nancy Flynn's The ePolicy Handbook covers a wide range of topics and concerns.

This book covers all of the key points and provides some excellent topics to include in a corporate e-policy. The goal of this book is to aid you in developing a policy that will provide clear, enforceable guidelines to your employees in the acceptable use of the Internet and electronic mail, and to protect your company's image.

It starts out with a well developed approach to assessing your current situation with respect to Internet and software usage, and provides a handy list of questions to aid in this task. The key objective is to discover your company's exposures and what abuse of systems or services [if any] need to be immediately addressed by the policy.

In order to fully understand the results of your assessment and how they relate to risks and exposures, the author provides fundamentals of "cyberlaw" and general security concerns that will indicate, roughly, the degree of risk your company faces. These are important considerations for tailoring an e-policy to which your employees can relate. I liked the chapter on cyber insurance products and how they can be used to transfer some of the inherent risks to an underwriter. I didn't even know such policies existed. The author also addresses software piracy, which can be a big issue because the world wide web has many sources for pirated software (commonly called "Warez"). It goes without saying that pirated software can expose your company to legal headaches and expenses, not to mention technical headaches and lost productivity that will occur if that stolen software also comes with a virus attached.

The book then shows you how to develop an e-policy that is based on your assessment results, and the issues previously discussed in the book. What is valuable here is that the author provides a list of all elements that need to be included in the policy. Moreover the next chapters provide additional material that will prove to be invaluable in preparing your company for the policy. For example, there is a "Netiquette" primer for employees, on-line writing guidelines, and advice on training your employees. The training aspect of implementing an e-policy is especially important because many employees have home computers and are experienced Internet users. They might consider themselves to be experts and may resent being "constrained" by a policy that dictates how they use the Internet at work. Educating them and getting their "buy-in" is essential, and the author provides some effective ways to get that "buy-in".

I found the sample policies in the appendices to be particularly valuable to use as guidelines for drafting a clearly-worded policy that covers all key elements. The applicable laws cited in the appendices were also valuable because they indicate the many sources of legal risks (and protection) that touch an e-policy.

This book provides an excellent starting point for developing an effective e-policy that can be closely tailored to your company and "sold" to your employees. Its clear writing, completeness and sensible advice earn it 5 stars. I will offer one caveat: any e-policy developed based on this book or any other should not be issued until it has been carefully reviewed by legal counsel. I am not an attorney (I am a computer consultant by profession), however, I do know that such a policy touches so many aspects of privacy and employment law that you may put your company at greater risk by implementing a policy that has not been reviewed by qualified legal counsel than by having no policy at all.

    This is a really good book for a Net Admin such as myself. It explains all the legalese very well and I don't see any aspect of policy that it doesn't touch on. There are lots of great quotes you can put into your own policy document.

    The one complaint I read about it being "thin", is somewhat accurate. It's less than 150 pages, but there is a lot great information in those pages. My only complaint is that you will have to type all of the policies into your own document. They are not provided electronically. Add a CD to the book, or a web site where the samples can be downloaded and I'd give 5-stars.

    I like this book. It is very readable, concise, practical and easy to follow. The author has done an excellent work to put this vast field of legal and technical knowlege into a very readable form for average reader in business and management.

    Provides guidelines for developing policy governing the use of computers, e-mail and the internet. Focuses on reducing legal liability, protecting confidential, proprietary information, and guarding against the waste of information technology resources. Filled with many examples of policies. Includes text of selected laws and regulations and a useful index of sample clauses. Should be on every CIO's, VP, IT and VP, HR's bookshelf. Recommended.

    It's written for the lay person who needs to formulate IT policy. It gives both policy statement examples and background data to permit the reader to formulate policies to suit their business needs. It was exactly what I was looking for.

          Anyone who works in the Library and Information field need to get this book. This resource will save you alot of mental and financial problems as well as stress. The author does not make the assumption that the reader knows the subject area. This resource is written so that a layperson can understand it. After every chapter there are references that one can peruse if he/she so desires. The appendix is wonderful. The table of contents is methodical and logical. It is a great reference resource and a good read!!
