3 out of 5 stars Detailed and theoretical.......2006-03-25

As a beginning mediator, I found this book very detailed and theoretical. I am sure that I will return to it again and again as I gain experience. I found "Basic Skills for the New Mediator (2d edition)" by Allan H. Goodman to provide a quicker and more practical overview. When used together, I believe both books are a good basis for the practicing mediator.

This book was great and exactly how it was described in the review. I received it at a fast pace.
Thanks.

    Book Description

"This much needed book . . .is a creative, helpful, and hopeful contribution at a time when we are especially challenged to bridge cultures in the pursuit of mutual understanding and peace."
    — Jimmy Carter, Nobel Peace Laureate

In our global society, challenging conflicts abound in personal, business, government, and international settings. Many of these conflicts are complicated by layers of miscommunication, cultural misunderstandings, and completely different ways of looking at the world. These conflicts cannot be solved by goodwill or sincere intentions alone. In our multicultural world, we need new tools to address gaps in communication and understanding and the conflicts that flow from them.

Bridging Cultural Conflicts answers this need in groundbreaking ways that cut through complexity, replacing confusion with clarity. It introduces mindful awareness, cultural fluency, and conflict fluency as tools for decoding and moving through intercultural conflicts, and for deepening and integrating change. The book shows how fluency with culture and conflict can be learned through attention and practice, just as we would internalize a new language. As fluency is acquired, a process called dynamic engagement is presented to help prevent intercultural conflict, limit its escalation, and transform it into a learning experience.

Michelle LeBaron's approach in Bridging Cultural Conflicts is human, practical, and adaptable to a wide range of interpersonal, community, organizational, and political conflicts. Drawing from her work as an attorney, mediator, scholar, and internationally acclaimed consultant, Michelle combines the dynamism of Western approaches to conflict resolution with the insight and balance of Eastern approaches. In the process, she offers a wide array of creative strategies and usable tools. As we urgently seek better ways to work and live together and to address the issues that divide us, this timely book inspires flexibility, creativity, and hope.

This is an extraordinary book. For those of us involved in cross-cultural training and negotiations work, this book brings together a progressive practioner's life experience and emotional intelligence to create new ways of framing our work. I used up a "highlighter" through the first two chapters. If your work is in mediation, cross-cultural communication, conflict resolution, negotiation, or facilitation, this book is a great investment. If you just want to know more about interactions between people and yourself, and come to better understand the internal dialogues you have when you are conflicted, this is a great, entertaining, and enlightening read.

    Book Description

Extreme Facilitation picks up where other books on the topic leave off to present a revolutionary method that helps large, unwieldy, adversarial, and apparently dysfunctional groups achieve consensus and reach objectives on divisive and contentious issues no matter how long the group has been struggling. Throughout the book, expert facilitator Suzanne Ghais shows how extreme facilitation - which puts on the emphasis on creativity, flexibility, and customization - can change how group members interact with one another and how participants view the issues even in the most challenging and exceptionally difficult situations. Extreme Facilitation covers the preparatory phases of the process, including assessment, convening, and contracting. Ghais also offers vital information on process design and tips for handling situations that many facilitators find particularly challenging.

    Customer Reviews:

5 out of 5 stars As Good As It Gets.......2007-03-01

I love this book! I teach facilitation & have recommended Extreme Facilitation (EF) to my students. If you are an experienced facilitator, EF's insights will improve your practice; if you are a new facilitator or just thinking about learning the facilitator's skill set, EF will help you understand what the craft is all about; if you are a manager, or work with community/non-profit organizations, and have not used the services of a facilitator, EF will change your mind. Extreme Facilitation is important because once you know and use the facilitator's skills, you will save time, money & avoid a lot of the pain involved in getting two or more people to work out their differences & unite toward a common goal. Ms Ghais accurately demonstrates in words what a facilitator does and the benefits of using these skills. Her descriptions of the practice of facilitation, particularly of its role in conflict resolution, have a realness not found in many books.

5 out of 5 stars On a Scale of 1-5, This Book is a 10.......2006-04-21

You don't generally think of books like this as "page-turners", but I could not put it down. In Extreme Facilitation, Suzanne Ghais has moved away from the cookbook (techniques-based) view of facilitation found in many other books and training materials, and has captured the core principles that underlie successful facilitation in extreme situations. For example -- there are no "difficult" people in a group; rather "difficult" behaviors reflect needs or interests that have not yet been identified or adequately addressed. Once these needs or interests are understood by the group and dealt with, the "difficulty" usually passes.

I started reading the book while stuck on a process design for a complicated project. The book's direct and insightful approach unlocked my creativity and allowed me to trust my instincts -- ie, the book facilitated my own thinking in the same way that "extreme facilitation" empowers difficult groups to work together productively. Ms. Ghais' approach to the topic is transformative.

5 out of 5 stars A WEALTH OF GOOD IDEAS, ILLUSTRATIVE STORIES, & USEFUL INSIGHTS!.......2005-08-27

The author has produced an extremely comprehensive and well written book on facilitating in the most challenging situations. Such situations call for more depth, adaptability and strategy than is addressed in other books on facilitation; this book's aim is to provide powerful, highly focused guidelines for the toughest facilitation challenges.

The author takes a situational-facilitation approach: the successful approach must be tailored to the unique nature of the facilitation challenges of the moment. Because the book focuses on the more contentious predicaments, conflict resolution is infused throughout this work.

The profile of the extreme facilitator is one who is an architect of custom processes, has a deep understanding of the group, can draw on a wide knowledge base of possible techniques, has a strong personal presence, and is able to employ all of the group's capabilities. This book delves into the critical details, providing guidance on preparing for and conducting the facilitation process, focusing on each of a groups capabilities-physical, intellectual, emotional, initiative, creative, and spiritual. The book is filled with a wealth a good ideas, illustrative stories, and useful insights.

    Customer Reviews:

5 out of 5 stars A very entertaining and resourceful read.......2006-06-22

Mr. Krivis has succeeded in creating a very entertaining and resourceful book that anyone in the conflict resolution arena would find a must read, including attorneys, mediators, claims adjusters, negotiators, human resource personnel, private parties in conflict, and the list could go on and on.

I enjoyed the book because it was written with such detail and specificity in a John Grisham type style, yet at the same time it was also very educational and applicable. The material was so good and entertaining that I found myself at the end of each chapter saying, "Okay, one more chapter then I'll go to bed." Then a half hour later, "Okay, really just one more chapter."

Mr. Krivis has shared in this book many valuable tools that I have already applied in my private practice as an attorney and mediator. I can testify that they have tremendously benefitted my clients and my practice. For this reason, I find myself referring to the book weekly and frequently recommending it to my colleagues. Thanks for the great read Mr. Krivis and subsequent enhancement to my practice. This book is a must read!

5 out of 5 stars Practical advice - buy this book to help with mediation.......2006-03-29

I often look at reviews for practical advice, i.e., if people like me read the book and get something out of it, then I want it. Well, as a trial lawyer and as someone who would benefit a lot from doing my best at mediation, Jeff Krivis' book is a DEFINITE READ. Mr. Krivis' style is clear and very easy to understand. After setting forth various fact patterns that an experienced lawyer might see, he shows how different approachs to meditation settle the case. This is a window into how to a top mediator thinks about your case and the strategies he uses to help both sides resolve their differences. What could be better?

In case I wasn't clear - BUY THIS BOOK.

    5 out of 5 stars Krivis: A Litigator's Mediator.......2006-03-21

I have been a full time mediator for seven years. Before that, I was a litigator. At times, I utilized Mr. Krivis' expertise as a mediator. I recall thinking: "This man's an alchemist. He settles all of my cases, but does so in a different way each time. He truly is an improvisational genius." Now, through his new book, Krivis gives me some insight into his practice. This book should be required reading for anyone currently mediating the litigated case. It should also be read by litigators. The analysis sections at the end of each chapter provides a wealth of information for sorting out differences of all kinds. Don't wait for the jury, ladies and gentlemen. The verdict is in: Krivis is a master mediator with an inpired approach to conflict management and resolution.

5 out of 5 stars The Human Dynamic in Conflict Resolution.......2006-02-28

What do love, money, anger and conflict have in common? Among other things, pioneer Southern California mediator Jeff Krivis. Now this legendary "closer" has written an original and engaging new book "Improvisational Negotiation: A Mediator's Stories of Conflict About Love, Money, Anger and the Strategies That Resolved Them".

Focusing on the "human dynamic" involved in dispute resolution, Krivis' book reads more like a fast-paced novel than a work of non-fiction. In 30 riveting chapters, Krivis takes the reader behind the scenes and far beneath the surface of conflicts that everyday people face and his (and others) strategies for their resolution. Given the general public's overwhelming interest in the law and what lawyers do, this book should enjoy an appeal far beyond the sphere of dispute resolution professionals.

    It deserves a wide audience.

5 out of 5 stars Inside the mind of a master negotiator.......2006-02-25

Through the gripping stories contained in this book, the reader gets a rare and highly coveted opportunity to observe the author (an internationally recognized mediator) at work in the most challenging of situations. Jeffrey Krivis, known for his skill and success in breaking through even the most difficult negotiation barriers, shares his techniques and tools for achieving resolution and does so in a fabulously entertaining and heart-warming way through these well written stories. It's a must have for every negotiator or mediator's library.

        Book Description

With the explosion of workplace litigation and the skyrocketing costs associated with it, employers in both the private and public sectors are seeking new ways to swiftly and inexpensively resolve disputes with their employees. Alternative dispute resolution (ADR) procedures offer ways to do this and, according to recent reports, more than 100 major corporations have made use of them. Not only are the costs of trying a workplace dispute before a jury avoided, but also due process requirements have been observed. McDermott and Berkeley introduce executives to ADR, how it's done, and its benefits. This book will be interesting and important reading for executives and for legal counsel that may be unfamiliar with ADR. The reader is first introduced to the employment litigation revolution that is sweeping the country. The authors explain the various contextual factors that have caused this rise in litigation, including the Civil Rights Act of 1993, the Family and Medical Leave Act of 1990, and the Americans with Disabilities Act. Given this new legal environment, the book explores how ADR can assist an employer in avoiding or reducing the costs of employment law litigation. The subject of ADR is divided into mandatory and nonmandatory procedures. Finally, the authors discuss how an employer can introduce a binding arbitration procedure that diverts employment litigation from a jury to an arbitrator. Drafting tips and model clauses are included should an organization seek to develop a mediation procedure, arbitration procedure, or both.

In a democracy, the problem of fair division of goods is fundamental. It is, for example, what's lurking behind contemporary discussions of affirmative action, divorce law, and even of Medicare and Social Security. Its flip-side problem--burden-sharing--which is implicated in such issues as taxation and the draft, is likewise central. The authors, one a political scientist, the other a mathematician, start with an analysis of the well-known cake-cutting paradigm of "I cut, you choose" and gradually soup it up into a model capable of accommodating situations in which there are more than two parties, or more than one good. They emphasize division procedures that are not only proportional (that give each of n claimants a 1/n share of the good), but that also have the psychological property of being "envy-free"; that is, producing allocations in which each participant thinks (often wrongly, obviously) that he received the largest portion.

        Book Description

Cutting a cake, dividing up the property in an estate, determining the borders in an international dispute--such problems of fair division are ubiquitous. Fair Division treats all these problems and many more through a rigorous analysis of the well-known cake-cutting procedure.

Steven Brams and Alan Taylor accomplish something quite interesting and worth paying attention to. They move concepts traditionally treated in policy debate and law with simple hit-or-miss human judgment and discretion into concrete analyzable mathematical processes. In the more than ten years that I've worked on the mathematics of child support, I have not yet been so convincing that such a transformation from subjective into objective is possible. Let the games continue!

5 out of 5 stars A comprehensive resource, easily read.......2000-07-25

This was easily the book I referred to most in my Master's paper on fair division. It covers a lot of topics, including envy-free and equitable division, fair division by auctions, and fair division by elections. The authors devote a chapter to their favorite method, the so-called "combined procedure" that is equitable, envy-free, and Pareto-optimal for two players and would be invaluable to any divorce lawyer.

For those accustomed to reading mathematics or economics, this book is readable. For the layperson, it might be a little bit too technical in spots. While it has many practical examples, it isn't really a fair division manual for the do-it-yourselfer. But it's as close as you're going to get, for now.
