Anyone who has ever been a landlord knows that the rental business is tightly regulated. As the authors of Every Landlord's Legal Guide point out, "a landlord either knows and follows the law or doesn't stay in business long." This book clearly outlines what the law requires of a landlord and, just as importantly, offers advice on how to be conscientious yet profitable. This useful book is filled with helpful information on finding good tenants, agreements and leases, liability issues, and even terminations and evictions. The advice is extremely thorough. For example, the chapter on the landlord's maintenance duties contains information on who is responsible for minor repairs, ways to avoid problems by instituting a preventive-maintenance program, and even possible tenant responses to landlord negligence. The book is rounded out with a chapter on finding a lawyer and an appendix of state laws that may affect your business. Dozens of sample forms are included both as blank hard copies in the book and as templates on the enclosed disk. This book is extremely user-friendly: Stilted legalese is translated into simple English, handy icons highlight particular points in the text, and sidebars provide in-depth analysis on a variety of issues. The authors maintain that success is based on "choosing tenants carefully, keeping good tenants happy, teaching mediocre tenants how to improve and getting rid of bad tenants by applying policies that are strict, fair and legal." This book will help you do just that. --C.B. Delaney

4 out of 5 stars Every Landlords legal guide, eighth edition.......2007-04-10

Havent had a chance to go through the entire book; expect I will refer to it when I have a need to do so. It seems quite thorough, though maybe not laid out in a user friendly style as it could be.

5 out of 5 stars A Lead for New Landlords.......2007-03-31

This book is the perfect starting point for people wanting to get into the rental business. Provides you with answers to some questions you didn't think to ask.

3 out of 5 stars Nice beginning, but beware of state law!.......2007-02-25

This book gives you a good first overview, but you absolutely have to get a book on your state's regulations as well, especially if you live in a highly regulated state like Massachusetts. This book for example only gives you a vague idea on how to handle the security deposit, but Massachusetts state law is very specific and not following the rules precisely may cost you the deposit plus penalties.

5 out of 5 stars Great reference tool for marketing professionals.......2007-05-17

This is a very expert guide in a very accessible form. It has great information in a friendly easy to access format that is very helpful for clarifying complex issues. I think this is a good tool for anyone who owns their own business or is a marketing professional who deals with intellectual property issues.

This makes it easy to understand the difference between trademarks, registered trademarks, copyrights, and various patent types.

5 out of 5 stars You won't file a patent tomorrow, but you will have a much better idea of how........2007-04-14

This was a really great read. The book doesn't lay out a step-by-step method for filing patents or trademarks, but I think it is a lot more useful than a book like that.

The book gives a great detailed look at what each creative protection (patent, trademark, and copyright) can do for you. It does a really good job of explaining the protections, the requirements, and when each is appropriate. It also has a lot of great pointers on how to maximize your benefits and what to do when your rights have been infringed upon. I highly recommend it to somebody who does not know much about these areas and would like to know more. It is a great start into the world of idea protection. A quick read and really easy to understand.

5 out of 5 stars Everything You Need To Know.......2007-03-23

When does a great idea turn into a personal fortune? How about when you hit the "send" button? Whether you're a novelist, inventor, a blogger or someone with the best chili in your town, today's technology makes it possible for the innovator toiling away in a kitchen or a garage to become an international marketer. It's also the perfect opportunity for your idea to become someone else's fortune. And that's where Mostert and Apolzon come in. They are two of the world's top intellectual property lawyers and, without a sentence of legalese, they define the major forms of intellectual property, dispel myths and tell you what you can do to register and keep your idea your own. The book is also colorfully illustrated with case histories of how products from Coca-Cola to Velcro became household words and how they stay that way. If you're thinking maybe your recipe or poem or song should be shared with the world, save yourself a lot of aggravation and put this book on your shelf.

5 out of 5 stars I love this book! It shows you how to protect your work.......2007-03-22

I really love this book! It explains in plain English how to protect your creations, whether they are artistic or useful. I sent it to a friend, whose brother invents all sorts of handy little gadgets, and he uses it. I sent it to my mother, who is a painter, and she uses it. I also sent it to a friend who writes how-to manuals, and he uses it! The book is easy to understand, and it's full of wonderful photographs and entertaining examples of the use of trademarks, copyrights, and patents. I never thought learning how to protect my work could be so interesting!

This set me straight on a few things while setting up my business. It is well written and easy to understand. I would recommend this to any 1st time business owner starting out.

5 out of 5 stars Great book!.......2005-01-07

Full of the information you expect based upon the title of the book. The information is detailed so you have the guidance you sought.

This book is like an encyclopedia of small business. I'll definitely be returning to this book throughout the years.

5 out of 5 stars Just what the doctor ordered!.......2004-05-19

Nolo's Legal Guide to Starting and Running a Small Business was exactly what I needed to help start my company off on the right foot. I don't have a very strong legal backround and would have been way over my head if I'd tried to forge ahead totally alone but at the same time I didn't want to spend a fortune consulting a lawyer. If you're in a similar situation then Nolo's Legal Guide is the perfect solution. It is well written, well organized, thorough, and very easy to use. It's a great general start-up kit that would be helpful to any fledgling business that I can think of. If I had had to call a lawyer to answer every legal question that arose in the first couple of months (a huge number) then my company may easily have never gotten off the ground. I was so pleased with this product that I have since purchased two more Nolo books (Tax Savvy for Small Business and The Employer's Legal Handbook) that are more directed at business owners who have gotten through the initial start-up phase. Both of these books are also excellent and I would recommend them as follow ups to the Legal Guide to Starting and Running a Small Business.

5 out of 5 stars Complete Legal guide for STARTING a business........2003-08-11

There are several books in the market on how to incorporate your company based on the state. Even though there is an advantage to these books as you get state specific information for filing paperwork to incorporate, usually there isn't any other information in these books that you can use.

This Nolo guide on the other hand stays kind of generic in the sense that they don't spend too much time in how to fill out the incorporation forms and where to file. Instead, they give good information on every subject you would need to research when starting a small business.

The book starts off by explaining the different legal forms of corporate entities you can choose for your business and details each of these forms in the next three chapters. After this, there are more than 20 chapters devoted to almost any kind of situation you may encounter. For example - there is a chapter on Resolving Legal Disputes, a chapter on Small Business Contracts, a chapter on Home Based Business, etc. Some of the topics I had no prior knowledge of and gained tremendously from - Retail Pricing and Return Practices, Zoning Laws, Deducting Expenses for Business Use of Your Home, Workers' Compensation, Thirteen Common Sources of Money, and Strong and Weak Trademarks.

This is a good book to read when you are STARTING your own business. After that, you will probably need to research more into the topics that are relevant to your situation. Otherwise, there wouldn't be so many different legal guides that small businesses can use (from Nolo). Obviously, as your particular situation becomes more unique you need to refer to the specific books that have an advanced treatment of that topic. And finally, it is always better to seek a lawyer's help after being aware of the basics of the Law.

As usual, Nolo does a fantastic job of covering a broad range of topics in a very detailed fashion without losing the reader's attention. There are a lot of examples to explain the various topics and everything is in plain English. I especially like the references to the IRS forms and publications you need in various circumstances. When you go to the IRS website, it isn't clear which form is relevant to you. It's neat that Nolo makes sure to reference the right form when they are discussing a particular subject.

I hope your small business succeeds and that you find this book helpful in getting things started. Be sure to check out the other Nolo books when you are past the initial stages and definitely build a good working relationship with a trustworthy lawyer for times of need. Good luck!

Book Description

You can't touch it or feel it. Sometimes you can't even see it. Yet, intellectual property continues to soar in value, comprising an increasingly greater portion of a typical company's assets. In the age of instant global communication, understanding what intellectual property is, how to protect it, and how to enhance its value are prerequisites for corporate survival.

Enter attorney Deborah E. Bouchoux and her informative book, Protecting Your Company's Intellectual Property. Packed with fascinating and illuminating examples, this book is a succinct, yet comprehensive discussion of the four key areas of intellectual property: trademarks * copyrights * patents * trade secrets.

In addition to defining these areas (for instance, did you know that customer lists and marketing plans are protectable trade secrets?), the book offers practical tools for protecting intellectual property, including:

* Trademark and copyright application forms
* Sample employment agreements
* An Internet usage policy
* Tips on preventing unauthorized dissemination of information via the Web
* A guide for conducting an IP audit, and much more.

Customer Reviews:

5 out of 5 stars Excellent IP overview for managers and investors.......2003-06-25

This book offers a comprehensive overview of intellectual property issues, suitable for (among others) high-tech executives, entrepreneurs, and investors in early stage companies (all of which describe me). Its coverage includes trademarks (6 chapters, 70 pages), copyrights (5 chapters, 68 pages), patents (4 chapters, 40 pages), and trade secrets (1 chapter, 18 pages), plus chapters on unfair competition, owning IP created by employees and independent contractors, and conducting internal IP audits. I have experience with software copyrights and biotechnology patents; this book is fairly strong on the former, but only briefly mentions the latter. The material on internal IP audits is rather brief (12 pages) but includes a fairly good audit checklist, and an action plan for protecting a company's IP; also, the first chapter should be required reading for managers, since it points out the many places in a business where valuable IP may be found, department by department.

The writing is very clear -- certainly not "obtuse" as one reviewer claimed -- and the book is quite current, with good coverage of the Internet's impact on copyright and other IP issues, and coverage of recent changes in the law such as the Digital Millenium Copyright Act. The book is a high-level overview for managers rather than a lawyer's or practitioner's guide, but it does describe the application process for trademarks, copyrights, and patents, all in reasonable detail. Yet this book is just 250 pages of highly readable text -- not a huge tome -- which I think makes it suitable for managers, early stage investors, or board members, especially in high-tech companies.

1 out of 5 stars Save the money.......2002-04-21

I found this book very obtuse and thought the author tried to make this subject much more difficult than it really is. Save your money.

5 out of 5 stars Highly Recommended!.......2001-09-28

In the interests of safety, we'll refrain from quoting this fine book by Deborah E. Bouchoux, a specialist in intellectual property who teamed with AMACOM to create that rarest of volumes: a straightforward book about law that is simple to read (it's a formula she should patent). This comprehensive volume covers the nuts and bolts of U.S. patent and trademark law. It also gives advice on how to protect your intellectual property and avoid infringement, and reports on the latest patent trends in high tech. Of most concern for general business managers, Bouchoux reviews how (and why) to conduct intellectual property audits within your organization. With intellectual property emerging as the new corporate treasure of the knowledge economy, we [...] suggest that research and development managers and executives of every stripe study this volume carefully. Why should your attorney be the only one who understands what you really own?

5 out of 5 stars Very Well Done.......2007-06-12

I actually thought I was purchasing the software which would have typed up many of the sections for me - which would have been nice, but I was very impressed with how well organized and informative the book is.

Many items include the actual state laws regarding rental property which is very helpful because many of the websites are not easy to navigate.

5 out of 5 stars Worth every penny!.......2006-10-31

I will be a first time landlord and have done alot of research online as well as other books and had continued to come up short as far as detailed explanations and suggestions. This book is it! It has literally everything you need and is extremely thorough. I borrowed it from the library and have come here to purchase it. I can't do without out it.

    5 out of 5 stars The landlord's bible.......2003-09-04

I was very satisfied with this book. It was so comprehensive and easy to read -- even for a non-business-oriented, non-real estate-trained person like me. There are examples, thorough explanations, form examples, and perforated, blank forms.

I think this book is must-have for every landlord or recommended for those thinking of becoming a property mgr. or landlord.

4 out of 5 stars What can I expect to deal with.......2007-10-20

This book will give you insights into what to expect when "the event" occurs. It should be read before you except the responsibility. An executor is not just another job.

5 out of 5 stars Good overall knowledge.......2007-02-09

This book gives great overview but it is not a do-it-yourself book. You'll still need legal advice. Highly recommend as a read so you can be educated before speaking with a lawyer.

5 out of 5 stars Short, sweet, and to the point.......2006-05-03

After reading this book you can probably be an executor for an estate without hiring an attorney (assuming no legal documents have to be prepared or filed in court). I found this book in the reference section of the Westfield Pubic Library (NJ) along with its companion book: A Family Guide to Wills, Funerals & Probate (ISBN: 081604550X). This book was written for an executor to read, and the companion book concerned much of the same material but for the decedent to read before he or she dies.

I thought this book was great, and that it will help an executor gain a grasp of his or her responsibilities when administering and closing a decedent's estate. It is written without legal jargon. Have you ever had to administer an estate and gone to an attorney for help? Did you expect the attorney to tell you about your duties and delegate as much of the work to you as possible? And did you find the attorney did a lot of work you think you could and should have done? Well, if so, then this book probably could have helped you talk to the attorney and have more worked delegated to you.

This book is as comprehensive as it needs to be to educate an executor about his or her duties. When those duties can be complicated, the authors explain the basics so an attorney can be consulted to provide legal services. Keep in mind that many estates can be settled without any legal help being needed. Thus, I recommend an executor read this book before ever seeking an attorney for help, guidance, or services.

The edition of the book I read was hardbound and very pretty. There was an index of terms in the back of the book. However, I would have liked the book better if there had been a glossary of terms back there, too. Don't worry that the book doesn't have your state in its title. It is written so it is applicable to executors in all 50 states.

I found the book to be deficient in covering (failed to cover) the various tax forms (federal estate & income; state estate & income) that must be filed. They mention them, but I would have liked the book better if more had been written about them. Filing the tax returns is often the most complicated aspect of doing executor work. Most of the other things just take time.

5 out of 5 stars A Must-Have Book For The Newly Appointed Executor.......2004-06-10

I purchased this book months ago to prepare myself for the future when I will have to handle my mother's affairs. To my absolute surprise, I have recently been appointed as administrator of my long lost cousin's estate. Yeap, he died intestate, without a will. Luckily I was just finishing this book so I had a clue what to do next.

The book has already proven to be a valuable resource of information. As I go through the probate process, I am referring to it to help me along. I put Post-It note flags on the tops of certain chapters to speed up the information retrieval. The Table of Contents is well organized.

The only thing I would suggest to the authors is to put a bit more "how to" instructions into the book. For instance, I need to do a Postal change of address. The topic is well covered in the chapter "The Deceased's Mail" but it does not tell you how to locate the Post Office where he once lived. A website address would be most helpful.
