Book Description

There are over half a million high-net-worth individuals in the United States. Already 5 percent of them have private foundations, and interest in setting up charitable organizations is on the rise--due to the estate and tax-planning advantages offered by foundations and the growing desire of many to give back to the community. Creating a Private Foundation is a straightforward and authoritative guide for individuals and families looking at the pluses and minuses of creating a foundation, as well as for the advisers who serve these high-net-worth clients. It explains the reasons for establishing a foundation, the steps for setting one up, and tips for avoiding common pitfalls. Author Roger Silk covers the ins and outs of private foundations from the perspective of both philanthropists and the professionals who work with them.

4 out of 5 stars private foundation fundamentals.......2006-03-09

The book is more for donors than advisors. I does not provide enough of the necessary essential legally technical information.

5 out of 5 stars Useful Primer.......2003-11-01

Unwitting new philantrophists sometimes end up with bureaucratic creatures that do exactly what the donor did not want. This book is full of practical advice on how to avoid unpleasant surprises if you set up a foundation of your own, such as finding out that you have no control over its activities.

It also gives a succinct review of investment problems. Foundations can potentially last for many generations. But they can easily mismanage themselves into oblivion in short order. The authors identify seven deadly investment sins.

For example, foundations don't need to frequently redeem their investments, but some mistakenly invest in liquid assets and lose returns as a result. They would be better off with non-traditional investments like private-equity, income producing real estate, hedge funds, and timber.

Many foundations fail to diversify, unwittingly taking on risk. THey start with stock from the founder's company and continue to hold a concentrated position, exposing themselves to the vagaries of that business. In 2002 the David and Lucille Packard Foundation was forced to cut its donations drastically when Hewlett-Packard stock fell.

IN short, an easy-to-read, useful guide.

5 out of 5 stars Creating Private Foundation.......2003-06-16

A great great book to give to your existing Private Foundation clients, as well as those considering their options. The book hits on several key points among many others - which are the reason to formalize your investment policy statement(IPS) and donor intent issues. The author is correct that too often good intentions fail to result in effective results. It deals with other vehicles like charitable lead trusts (CLTs) and charitable remainder trusts (CRTs) as well as donor advised and support organizations. It is a big picture book not a technical how to for the attorney!

3 out of 5 stars Good basic guide.......2007-02-01

This is a picture friendly small handbook that puts a happy face ont taxes. Its a small history book that feels like a TAXES FOR DUMMY book. Its a little too happy really for a subject that is not the most upbeat.

4 out of 5 stars Good basic guide - helps understand the vocabulary of taxes.......2003-02-07

First, this is NOT a tax manual. This small and colorful book is designed as a general introduction to the process and vocabulary of the various taxes we all pay under varying conditions of income and investment. It is not a current guide to assist you in tax planning.

It gives you a basic introduction to the kinds of taxes we pay at the federal and local levels, the IRS, "paying as you earn", the annual (federal) return (with a nice general overview of the general applicable forms), audits (shiver!), and a little overview of tax planning. But, again, this guide's purpose is to provide a general overview and to provide you with basic concepts and vocabulary. Think of this as a good introduction to the topic rather than a practical preparation guide and you will understand what this book is trying to do.

It has lots of color and every page also uses helpful illustrations of the forms and processes involved in the tax process. Great for young people trying to learn what they are facing as the goverment(s) remove large chunks of their income to keep us in whatever it is we think we have from the government(s).

1 out of 5 stars OBSOLETE.......2001-11-02

Tax laws have changed dramatically since 1995. A lot of the information in this book is irrelevant now. Does not include infomation on newer tax credits.

WSJ must introduce a new and updated edition.

4 out of 5 stars Taxes in brief for beginners.......2000-03-31

This book was the right price and the right pace for a young person begining his or her life on their own. The Wall Street guide is comprehensive covering a quick history of taxes and then expounding upon the present state of US tax codes and the IRS. This book won't help you fill out your taxes nor contain the most up todate codes but may help make the frustration and confusion associated with filing much lest daunting and more bearable

This book is way out dated (1989). If you are looking for specific up to date information to open an account it's a waste of your time and money. If you want general information about the banking system then it's worth the read.

This book is clear, consise and expertly researched. I've read other books on the subject and found this to be the most helpful and enjoyable to read. I highly recommend it to anyone considering a Swiss bank account. This book will tell you exactly what you need to know.

5 out of 5 stars indispensable.......2002-08-15

Combined an indepth analysis of legal issues with perceptive on point illustrative examples. Very helpful for my high school class.

2 out of 5 stars Colorful but lacking in substance.......2001-10-17

This book should please those who are looking for a colorful book to keep high school students interested in what many might consider a dry subject. It covers a host of topics and issues and will lead students to think. However, it is marred by its appalling ignorance of economic analysis. The worst example is in Chapter 2 where it offers up some comments on the "idea of profit maximization". Any student who has had a principles course in economics is likely to see these comments for what they are, namely the kind of rhetoric one would expect from someone manning one of the ubiquitous anti-globalization tables at a large university.

    Book Description

A sociological study of the issues involved in sharing the inheritance of summer houses, Passing It On fills a critical niche in the literature on estate planning. It focuses on the family dynamics involved in sharing real property rather than on the legal issues of estate reduction, with extensive quotes from over 100 respondents, all summer-house heirs, about how they have managed to keep the property in the family over generations.

    Customer Reviews:

5 out of 5 stars What about the cottage? Survival Lessons in Family Life.......2000-07-27

Remember the old adage "the family that plays together, stays together"? Summer houses may keep some families together but not mine. The arrival of spring and the end of summer heralded two major operations-- opening and closing my in-laws' summer cottage. For me their summer cottage became a place of enforced drudgery where I tried to gain acceptance as a dutiful daughter-in-law-until I stopped going altogether. Sound familiar? If your relationship with relatives is heading in this direction get copies of Judith Balfe's books about ways families SUCCEED at sharing and passing on summer houses before it is too late. Even after it is too late Balfe's book still provides insights into how families work through problems of sharing and ACTUALLY HAVE FUN TOGETHER.

Judith Balfe, a sociologist of culture, has produced a compelling reflection on the meanings summer houses have in the lives of owners, their heirs and other users. Passing It On: The Inheritance and Use of Summer Houses focuses on how families reach agreements about what is fair and fun.

Deep feelings often rise to the surface when family members must grapple with questions about how to share the benefits and the burdens. By thinking through these issues families can begin to develop their own solutions building on the experiences of people who have actually worked things out.

A second and much shorter companion volume, co-authored with her brother, Ken Huggins a professor of education, is intended as a short practical manual for developing agreements in changing circumstances-How to Pass It On: The Ownership and Use of Summer Houses. This second book is designed as tool to help families talk about difficult issues and sort out trivial conflicts that could otherwise tear them apart--covering a wide range of issues from rules about sharing toilet paper and allowing pets to dealing with personality conflicts, divorce, taxation and ownership).

Balfe and Huggins draw on their experience as brother and sister who worked through problems when they and their siblings had to deal with inheriting the summer residence from their parents.

In the main book (Passing it on) Balfe presents research from published sources and reports on a study of 125 respondents with summer houses in the U.S. and Canada. The respondents include "founders" (or the first generation of owners), heirs and other users of summer homes ranging from tiny cottages built on leased land to a privately-owned island off the New England coast assessed at US$8 million.

Some readers may prefer to skim the first three chapters about inheritance practices and theories of the function of summer homes and jump ahead to Chapter 4 when the voices of interviewees become stronger and practical advice abounds. But these are useful tools for thinking about the issues. Some accounts are hilarious depictions of the tensions of cottage life and others heartbreaking to read.

In this era of geographic mobility and family breakdown summer houses mean different things to different people- places to play, to express creativity, to work on projects or relax. They may sometimes provide a refuge for solitary retreats or romantic trysts, but in the warm weather months the summer house tends to fill up with relatives, in-laws and friends. These intense bouts of close contact make or break relationships. As people follow jobs to remote corners of the world and family elders retire in smaller abodes the summer home may become the only place where families can physically meet. In the words of one summer house user "This is where we are and do family"(p. 91).

Even within the same family inequities exist. Siblings frequently have different incomes and different levels of flexibility about vacation times; some live further away; some have many children; others none at all; some love pets others cannot abide them. Balfe presents a very useful analysis of various ways owners and prospective heirs plan for passing on the summer home and adapt to changing needs and tastes of family members. When is shared inheritance feasible? Do step-children have the same rights as blood relatives? Who gets to use the cottage during the best summer months? May brother's ex-wife who mother always preferred to her own daughters still have the place for a week each summer? And whose time is reduced as a consequence? Who pays for boat repairs? Should richer family members provide more funds for upkeep? How can handiwork for repairs, cleaning or renovations - or "sweat equity"- be taken into account? What financial, legal and administrative agreements need to be reached for successful sharing? How should owners plan for the next generation of users? When is multiple inheritance feasible?

This is a "must-read" for anyone faced with planning how to "pass it on". In fact I think it provides a useful set of guidelines for sharing other types of accomodation. I particularly liked the idea of the "Boast Book" - a journal of tasks and improvements left in the cottage in which sojourners record their contributions. Moments spent at summer houses certainly provide lasting memories. I wish my in-laws had talked about these issues long ago.

4 out of 5 stars Passing It On.......2000-07-21

"Passing It On" is a major achievement. Written by a sociologist, but not dry/abstract: it's full of wonderful human-interest stories.

The book is about second (vacation) homes, and how families share and inherit and strive to keep them going. Author Balfe and her brother (Ken Huggins) have also written a companion book ("How to Pass It On") which gives more specific how-to information. The reader should buy and read both.

I married into a vacation home on an island in Maine. One of 24 houses on the island. First, it was owned by my in-laws; now it's owned by my wife and her brother; and we've set up a system to maintain/preserve the house. Both generations in our families (current middle-aged adults and their children) are very committed to the house; but this is not always the way it is - so I read "Passing It On" and "How to Pass It On" with both interest and concern.

In January, I sent a memo to 75 other people involved in houses on our island. There I said, "'Passing It On' and 'How to Pass It On' are an important resource for anyone who's facing dispostion of property (and that's all of us!). It's a scholarly work, but it also full of very human stories of people like us. So do buy and read. If lots of you have done that by next summer, and you'd like to talk with Judy, I'm sure she'd be very pleased to come to our island for a week-end."

2 out of 5 stars Passing It On : The Inheritance and Use of Summer Houses.......2000-05-27

Although interesting, the book does not contain much practical information. It appears to be a college term paper that the author went on to publish. I do wish there were more usable ideas and realistic suggestions.

      Book Description

Tobacco, among the most popular consumer products of the twentieth century, is under attack. Once a behavior that knew no social bounds, cigarette smoking has been transformed into an activity that reflects sharp differences in social status.

Unfiltered tells the story of how anti-smoking advocates, public health professionals, bureaucrats, and tobacco corporations have clashed over smoking regulation. The nations discussed in this book--Australia, Canada, Denmark, France, Germany, Japan, the United Kingdom, and the United States--restrict tobacco advertising, tax tobacco products, and limit where smoking is permitted. Each is also struggling to shape a tobacco policy that ensures corporate accountability, protects individual liberty, and asserts the state's public health power.

Unfiltered offers a comparative perspective on legal, political, and social conflicts over tobacco control. The book makes a unique contribution to our understanding of how scientific evidence, global health advocacy, individual risk assessments, and governmental interests intersect in the crafting of tobacco policy. It features national case studies and cross-cultural essays by experts in health policy, law, political science, history, and sociology. The lessons in Unfiltered are crucial to all who seek to understand and influence tobacco policy and reduce tobacco-related mortality worldwide.

5 out of 5 stars Another quality title from Nolo that is worth every penny.......2007-04-05

Nolo Press was founded on the principle that not all legal transactions require retention of a lawyer. Many straightforward documents can be drafted and completed with the aid of a Nolo title sich as 101 Law Forms for Personal Use. This book, co-authored by attorneys, is divided into chapters on childcare and elder care, estate planning, will execution, landlord/tenant documents, financial documents, home ownership, personal property sales and rentals, home repair, living agreements, personal finances, consumer rights, and legal disputes. The forms are available in tear-out form and in a rich text format on CD-ROM. The rich text forms are perfect for editing and modification--one can delete and add clauses as necessary to customize the forms. I use this reference monthly for rental agreements, to draft complaint letters, and personal financial and consumer transactions. The language on the forms is simple and to-the-point.

This book is a steal at the cover price of $29.99, and Amazon regularly offers it at 30% off. Don't waste your time with software packages from the office supply store. Buy this quality product from a 35-year-plus leader in legal self-help advice. You stand to save hundreds or thousands of dollars in legal fees by doing this groundwork yourself. Nolo is quick to point out when situations get too complex for their simple forms, so be sure to heed the book's advice about turning to a lawyer if your situation warrants attention beyond the scope of the book.

These are simple law forms, and Nolo offers books which go into more detail on subjects such as landlord/tenant agreements and wills. While everyone should have this reference item in the home library, if you are planning to seriously set up your estate and trusts, or work part-time as a landlord, you should pick up one of the titles that goes into more depth on those specific subjects.

        5 out of 5 stars Great Title.......2003-07-04

This book is fantastic. There is a wealth of useful forms for everything you can imagine. I recieved this book as a gift and though that it would just take up space on my bookshelf. Ironically it has been the most referred to and used book I have ever owned. I have used the book to set up a power of attorney, prepare a tenants notice to move out, demand the return of a security deposit, complete a loan comparison worksheet, and to sell my dog. This book provides the forms and the explanation to do eveything I mentioned as well as a ton of other common transactions. It has saved me hundreds of dollars and I beleive that anyone who buys this book will cover the cost of the book within three months by making use of the forms and instructions provided.

5 out of 5 stars A must have for an intelligent frugal like myself.......2003-07-03

This book was terrific. If you have half a brain and like to save money this book is a must have. It contians almost every essentail form that you will need and it explians what they are and how to use them in a clear and concise way that even my nine year old niece could understand. And I guarantee that you will rely on this thing at least once a year for the rest of your life it is just that useful.

5 out of 5 stars 101 LAW FORMS FOR PERSONAL USE.......2000-05-16

I PERSONALLY FOUND THE BOOK TO BE VERY USEFUL AND INFORMATIVE. IT WAS EASY TO USE AND IT WILL ALLOW ANYONE, YES EVEN SOME ONE WHO HAS NEVER WRITTEN A LEGAL DOCUMENT BEFORE, TO MAKE THERE OWN IN NO TIME AT ALL. i WOULD RECOMMEND THIS BOOK TO BE A DEST REFERENCE FOR LEGAL SECRETARIES JUST STARTING OUT AND TO ANYONE WHO NEEDS A DOCUMENT AND WOULD LIKE TO DO IT THERE SELF.

1 out of 5 stars No Activities in this book.......2007-01-12

I bought this book hoping for some supplementary material for a sophomore taking a Law class using Adamson's Law for Business textbook. This turned out to be the exact same book that the teacher uses to photocopy "study guides" for the chapters. There are no "activities" in this book - just study guide pages. So we never used it.
