Book Description

This text provides the legal credibility, authoritativeness, and comprehensiveness of a traditional business law book, while also offering the visual appeal and student friendly features students are used to seeing in books for many of their other courses. Though the text is ?fun? for students to read, it does not accomplish this at the expense of important information ? it goes into the necessary detail to completely explain law topics. The book truly offers an instructor the best of both worlds ? a credible business law source, which students will be motivated to read. Its magic and the cornerstone of its widespread success is in this ability to appeal to both instructors and students without being mutually exclusive. It also offers the most comprehensive teaching and learning support package on the market, with something to fit many different instructional or learning styles ? a reflection of West Legal Studies in Business?s continual commitment to partnership, leadership, and innovation in providing the highest quality materials available for Business Law instructors and students. This text explicitly meets the AACSB curriculum requirements.

5 out of 5 stars A Straight Forward Text Book .......2007-05-27

It's a textbook. That being said, it is filled with extra material, like case examples, a CD-ROM, etc. I didn't look at any of that because my business law class went at such a slow pace we only looked at about 10 of the chapters. If you are buying this for a class, you should come away with a lot of good information from this book without feeling it is too much of a boring chore to read through.

5 out of 5 stars Great buy .......2006-04-05

Very fast delivery, thanks I was in a hurry and you have made me very happy.

5 out of 5 stars Excellent text for the Instructor; for the Student.......2004-11-01

This is an excellent text at various levels of interest, desire, talent and time. The text is arranged that given the time, the Instructor can dig deeper and deeper into thorny topics. Additionally, curious students can rely on numerous web sources for enhanced views and greater depth.

Further, there are additional sources for the Instructor available through test banks and outlines. This is my favorite text to teach from. It is neither dry with enough cases to stir the imagination of the younger students nor MTV'd and contains sufficient current cases to give older students and retired students pause to consider. 5 stars. Larry Scantlebury

5 out of 5 stars Not Only For Students.......2004-02-08

I am using this textbook in several of my classes, and let me just say- it has everything I could have hoped for. The chapters are laid out well, many cases are cited, and the student is given actual cases to figure out, with the citations given at the end so he can find the actual outcome. I've found this to be among the best textbooks. It is so good, in fact that I've reccomended it to several of my friends who are going into business for themselves. This covers nearly everything they'll need to know regarding contracts, secured transactions, warranties, etc.
Love the law!

5 out of 5 stars Business Law Today by Jentz et al........2004-02-03

This is an excellent text. It incorporates the law, as well as
legal research methodologies. For instance, a standard chapter
contains an outline, common law sources, constitutional,
statutory and administrative laws/rule-making. The work cites
computerized legal research in WESTLAW and LEXIS. Relevant
international legal citations are listed. The applicable
United States Code is cited by Title and specific paragraph.
In some cases, individual state legal codes are cited. There
are exhaustic sets of historical and statutory notes, cross
references and federal practice notes. Each chapter has a
comprehensive case study with a brief synopsis, cited case
and final disposition. There are teaching suggestions at the
end of the instructor's manual together with discussion
questions, research assignments and an explanation of footnotes.
In addition, there is an exhaustive section on essay question
answers.

Here is a model answer:
Stare decisis is a doctrine that prescribes following earlier
judicial decisions in deciding a current case if the facts and
questions are similar. Courts attempt to be consistent with their
own prior decisions and with the decisions of courts superior
to them. Stare decisis is important because part of the function
of law is to maintain stability. If the application of the law
was unpredictable, there would be no consistent rules to follow
and no stability.

The volume has detailed coverage of the following areas:
o Business Ethics o Int'l Business Law
o Employee Rights o Employment law
o Occupational safety o Accounting and the law
o Securities o Mergers and acquisitions
o Insurance o Real Estate
o Financial institutions o Unfair competition
o Advertising o Environmental law
o Health Care o Sports and entertainment
o Hospitality management o Communications
o Government contracts o Legal representation of business

There are significant software support systems; namely,
o Legal Clerk Research Software System
o Computerized Instructor's Manual
o Computerized Questions/Answers
o Case problems on diskette
o CD
o Lecture Builder Software
o Westest
o A Classroom Management System
o WESTrain
o Transparency Masters
o Sample Moot Court and much much more

This text is an excellent purchase for collegiate law students.

In Search of Stupidity is National Lampoon meets Peter Drucker. A funny and well written business book that takes a look at some of the most influential marketing and business philosophies of the last twenty years and, through the dark glass of hindsight, provides an educational and vastly entertaining examination of why they didn't work the for many of the country's largest and best known high tech companies. Make no mistake; most of them did not work.

Richly illustrated with cartoons and reproductions of many of the actual campaigns used at the time, marketing wizard Richard Chapman takes readers on a hilarious ride through the last twenty years. Filled with personal anecdotes spanning Chapman's remarkable career (he was present at many now famous meetings and events), In Search of Stupidity is a no-holds-barred look at the best of the worst hopeless marketing ideas and business decisions in the last twenty years of the technology industry.

"The history of marketing and technology is riddled with cautionary stories that stick up like dung covered punji sticks. Read this, and avoid stepping on one."
    Jeff 'Hemos' Bates
    Director OSDN Online
    Exec. Editor Slashdot.org

"Rick Chapman knows where the bodies are buried -- when most people have forgotten there was even a murder. This history of tech marketing disasters is well-written, enjoyable, and gets its facts straight."
    Jonathan Angel
    Senior Editor, West Coast
    Adweek's TECHNOLOGY MARKETING magazine

"In Search of Stupidity: Over 20 Years of High-Tech Marketing Disaster" gives us an amusing (and sometimes embarrassing) array of anecdotes of how far we've come (and not come) in high technology, as well as the path we've tread along the way. This is a fun read, with many invaluable lessons."
    Brenda Bennett South
    Vice President
    Weber Shandwick

"In Search of Stupidity is an invaluable history lesson in how to avoid monumental marketing mistakes that are unfortunately common in the software industry. Perhaps caused by the lack of institutional knowledge Rick points out that is caused by the youth of the industry, the only thing that would be stupid now is to not read the book! If you don't do it for your career, do it out of fear that Rick will highlight you in a sequel!"
    Alyssa Dver
    BusinessWeek special sections contributor

"'In Search of Stupidity' is a delightful and deceptively useful chronicle of what went wrong in the high-tech industry. Having followed many of these companies and products over the years, I'd often wondered why such smart people made such weird choices. Rick Chapman has many of the answers. Anyone who has ever yelled at the computer screen will enjoy this book."
    James Fallows
Former editor in chief of US News and World Report and a regular writer for The Atlantic.

5 out of 5 stars Computer marketing explained in an entertaining way.......2007-05-27

As a techie, I find most marketing books boring. This one was lively enough to keep me interested. The author uses plenty of hyperbole and sarcasm, so it's sometimes hard to tell fact from opinion, but in general, his analyses ring true.

4 out of 5 stars A grim, but highly instructive and entertaining story.......2007-04-04

I have been in IT since '79 and have seen all the companies Rick talks about come and go. The errors that were made, and still -are- made are mind boggling. All these proverbs about history repeating itself? They are right, when you don't learn from mistakes!

4 out of 5 stars Reading what you already know but didn't realise.......2007-03-08

What I liked most about this book that it puts a lot of known "history" in perspective, especially with regards to Microsoft.
The author puts a lot of humor into this book and understands how to put things into perspective. I do hope that there will be a third revised edition in the coming years.

5 out of 5 stars It's for anyone in marketing.......2007-02-08

The book is well-done and has some of the best software anecdotes... and discussions of marketing... that I have read in quite some time. I'm not in the software biz, but i have always been fascinated by it... and how its personalities can enhance, and in the cases you cited, undermine what are often very good products. I have been a marketer all of my career, and i felt that the paragraph on p 276 starting with "And then an awful realization..." was one of the best descriptions of what B2B marketing managers face and how difficult marketing management can be that i have ever encountered. I recommend the book highly for both entertainment and for marketing insights.

5 out of 5 stars New, updated edition of a classic.......2007-01-15

This is the second edition of Merril R. Chapman's best-seller In Search of Stupidity. To the first edition's collection of episodes of strategic blunders, marketing disasters and outright hubris on part of various high-technology companies during the 80's and the 90's, the new edition adds a few notable episodes. Companies listed include: IBM, Digital Research, Apple, Microsoft, MicroPro, Ashton-Tate, Siebel, Borland, Intel, Motorola, Google, Novell, Netscape, and various dot-coms from the Internet bubble times.

Apart from being a fun and enjoyable read, In Search of Stupidity is also a valuable resource for high-tech entrepreneurs, marketers and geeks wanting to turn their technical prowess into a profit. There's nothing like learning from the mistakes of others in order to avoid repeating them, and one of the merits of this book is that it does not limit itself to making fun of clueless companies, but extracts and digests from their tales a number of immediately useful advice.

So you can expect to learn how to avoid the same sort of positioning mistakes that doomed MicroPro, how not to inimicate the developer community that constitutes the lifeblood of your products, like Ashton-Tate constantly did, how to avoid damaging your relationships with the press, and many other useful tidbits. In this respect, the Stupid Analysis chapter at the end of the book is especially useful, in case you missed some of the more subtle lessons that were contained in the narrative presented in previous chapters.

In summary, this books is valuable both to entrepreneurs and managers, and to geeks who want to enter marketing, management or start their own company. Even if you are content with keeping a purely technical role, should you start recognizing the signs of stupidity on part of your company, you could at least be prepared to polish up your resume.

To be honest, it could be argued that some of the most egregious screw-ups described in the book were, at least in part, due to sheer bad luck, and that hindsight is always 20/20. Still I think that the stories told here teach some extremely valuable lessons. External circumstances alone cannot account for all that happened; it takes much stupidity and arrogance to turn unfavorable events into total disasters.

If you want to be picky, there is a couple of instances where the message of the book sounds a bit off. The first one can be found in the story of Google's fight with [...] over the issue of privacy, and its supposed bowing to the censorship imposed by the Chinese government. You can argue how much you like that Google acted stupidly in these circumstances. Its behavior might have tarnished its ethical image--"Don't be evil", remember?. However, it doesn't seem to have affected Google in any serious way; few people remember the episodes and Google is going as strong as ever. Compared to the other examples found in the book, this is a case of very mild stupidity, if at all, and it looks like Chapman seriously wanted to pick on Google but couldn't find any real damning evidence.

The second point is in chapter 12, The Strange Case of Dr. Open and Mr. Proprietary, where the author traces the beginnings of the Free Software movement to the first hackers who started out by illegally copying Microsoft's Altair BASIC. If one didn't know better, one might start to think that Free Software pioneers were just a bunch of freeloaders, if not thieves. In the rest of the chapter, however, Chapman makes it abundantly clear that the only example of stupidity, in this case, can be found on the side of proprietary companies who failed to understand the Open Source/Free Software movement and its effect on the software industry.

To sum it up, In Search of Stupidity is a very good book, especially if you missed the first edition. Five stars are well deserved.

I purchased this book as a classroom requirement for my MBA program. I found this book extremely easy to read with a wealth of information. Offering many examples, it is easy to see how the companies listed incorporated different strategies and policies to improve customer service and ultimately add value for the customer, the company and other shareholders. I found myself using this book as a reference source for research papers written for other classes taken later on in the program. This book is an excellent resource for any future business manager.

5 out of 5 stars An excellent book of Business Law.......2000-08-31

I bought this book a week ago. I am a foreign-educated lawyer and I have decided to compare Business Law of my country with Business Law in USA (learned at the US colleges and universities). I was pleasently suprised and also very satisfied with this buy. I appreciate very much the complete coverage of business law topics - especially integration of ethics, social responsibility, economics, historic issues into the presentation of business law topics as well as international topics. The book is written using clear language without problems of understanding as well as for non-native English readers. It was a perfect idea to include TOTALAW CD-ROM which provides access to 30 updated acts and statutes. I appreciate it. I would say the book worth its price and I highly recommend it to everybody who is in any connection with business law. I thank the author for unbelievable excellent work on this third edition of Contemporary business law book.

If you want to understand the 1990s, you have to understand venture capitalists. These are the people who listen to business pitches by the score, the financial-world equivalent of miners turning over tons of earth in search of precious metal. They're looking for the next Amazon.com, the next Yahoo!, the next eBay. Randall E. Stross, who teaches business history at San José State University, just happened to be there when a firm called Benchmark Capital discovered eBay. eBoys tells the story of how a group of not-quite-middle-aged men came to make an investment that returned a Silicon Valley record of 100,000 percent.

Stross is a gifted storyteller who weaves the personal histories of the Benchmark partners with stories of how the firm came to back such companies as Priceline.com and Webvan. We meet guys who weren't born to privilege, men who took unconventional routes into the venture capital business. Probably the most intriguing is Dave Beirne, a hyperaggressive executive recruiter who went into the business after realizing venture capitalists are the ones who really call the shots at high-tech start-ups. We also see the problems Silicon Valley guys have when they try to dot-com the bricks-and-mortar world. The short tale of an aborted partnership between Benchmark and Toys 'R' Us illustrates why the old economy is so mystified by the new.

Anyone interested in how business works should find something of interest in eBoys. From the organizational structure and corporate culture of Benchmark to the histories and personalities of its partners to its adventures in the world of Internet start-ups, it's a digital snapshot that reveals how successful businesses look, think, and mine gold in today's economy. --Lou Schuler

    Book Description

In eBOYS, Randall Stross takes us behind the scenes and inside the heads of the gutsy entrepreneurs who are financing the hottest businesses on the Web. The six tall men who started Benchmark, Silicon Valley's most exciting venture capital firm, put themselves at the cutting edge of the new economy by backing billion dollar start-ups like eBay and Webvan. The risks were enormous--but the rewards have proven to be staggering. Within two years, eBay's net worth grew from $20 million to more than $21 billion, while each Benchmark founding partner saw his own personal net worth soar by hundreds of millions of dollars.

For two roller-coaster years, Stross had total access not only to Benchmark's executives but to the companies they financed. He was a fly on the wall as fortunes were made in an instant, snap decisions got locked in, and new ventures took off--and sometimes crashed. Here are the testosterone-pumped conversations, round-the-clock meetings, and gutsy deals that launched the eBoys and their clients into the stratosphere of mega-wealth. Written like a novel but absolutely true, eBOYS brings to vivid life the glory days of the greatest business adventure of our time.

5 out of 5 stars a must-read for anyone in the startup world.......2006-10-08

As someone in the startup industry, hearing the VC point of view was very interesting. Add to that a refresher course on several of the important industry-shaping deals and an entertaining down-to-earth delivery style, and you got a certain winner on your hands.

Highly recommended, you will not put this down. I sure didn't.

4 out of 5 stars Hubris meets Homoeroticism.......2005-10-06

I give this book 4 stars for its inadvertently hysterical comedy. Everything you need to know to understand how the tech bubble formed and why it burst so dramatically is here--not in the story the author tells, but in the pseudo-macho, we-are-the-masters-of-the-universe, lets-measure-each-other's-penises subtext that runs throughout.

This is cultural history at its best. Not unlike the sex-ed books of the '50s and '60s that give us fascinating glimpses of the contemporary oppression of women, this book accidentally paints the late '90s silicon valley as the hotbed of homoeroticism that it was. The characters are greedy, hubris-filled, and completely blinded by the slightest scent of money--and the author worships their every move and utterance, seeing them as they see themselves: as gods among mere mortals.

There's not much here for the businessman, but plenty for the cultural historian.

4 out of 5 stars A good read with some good lessons.......2005-01-27

I doubt "eBoys" was intended to read as a period piece, but it certainly does in the post-technology bubble world. There are a couple things that come across loud and clear: first, these venture capitalists were not blind to the bubble that was forming; second, if they wanted to stay alive and relevant in their field, they needed to keep financing new companies and unwillingly participate in furthering the bubble.

The story is well-told and gives you an insider's view of how at least one venture capital firm makes the decision of who gets funding and who doesn't. It also serves as a cautionary tale about how even the most sophisticated investors get sucked into bubble mentality.

A valuable read for investors, entreprenuers, and aspiring venture capitalists.

5 out of 5 stars Amazing. Eboys + The Perfect Store = future billionaire........2005-01-18

I stand corrected on my earlier review of "The Perfect Store" -- Eboys has now usurped the title of "quite possibly the best book I've ever read." O.k. so I tend to exaggerate after I read a really great book, but this is definitely in my top 10 books of all time... and I'm a voracious reader (500+ easy... at age 28).

Informative, educational, entertaining, instructive, and incredibly motivating and inspiring -- for all those with an insatiable entrepreneurial spirit like the one I have, Eboys can be thought of as an entrepreneurial bible... or maybe hymnal would be more appropriate. I read the book and now I'm listening to the Audible audiobook... simply awesome... again! This is a must-have book for any budding Bill Gates, Micheal Dell, Jeff Bezos, Steve Jobs, or PIERRE OMIDYAR out there. Heck I even sent Benchmark the executive summary for my business even though they don't invest in my industry... I was just that impressed with those guys.

Read it. Save it. Refer to it. You'll be glad you did.

4 out of 5 stars not profound, but not prosaic either.......2004-10-01

Broad overview of the netherworld of venture capitalists as well as short take on eBay, the unlikely "profitable" internet company that learned how to scale its technology and augment its customer base with the help of Benchmark. As other reviews will corroboarte, it's this book's ebullient writing that salvages it from a more tepid rating.

      Book Description

Mallor, Barnes, Bowers and Langvardt’s, Business Law: The Ethical, Global, and E-Commerce Environment, 12th Edition, is appropriate for the two-term business law course. The cases in the 12th edition are excerpted and edited by the authors. The syntax is not altered, therefore retaining the language of the courts. As in the 11th edition, the 12th edition includes a mix of actual AND hypothetical cases. The title has been changed to reflect a new focus of the book – the global and Internet environment. Business Law: The Ethical, Global, and E-Commerce Environment, 12e includes new pedagogy such as opening vignettes and new-boxed features such as “Ethics in Action” and “Cyberlaw in Action.” This combined with case briefs and concept reviews, along with some reorganization of the text results in a more complete, relevant and user-friendly text.

book arrived timely fashion but was wrong book. Could not tell from description that this was a study guide and I needed "real" book!

4 out of 5 stars Great intro to law text.......2005-09-30

As an MBA student, this text was a great introduction to business law. The actual cases proved to be quite interesting and illustrative of the topics discussed throughout the text. You must go through the text before reading the cases or you may be confused, but the terms are so well laid out that once familiar with them, the cases are quite easy to understand and you are able to brief them yourself! Will serve as an excellent reference and I have decided to keep it in my library.

      5 out of 5 stars Excellent!!!.......2005-09-27

I could not be happy with the speed and condition of this item. I am very pleased with the purchase that I made, and look forward to doing business with them if needed. Thank you for the wonderful, and speedy service.

1 out of 5 stars Not reader friendly, not study friendly, not friendly...........2003-09-03

I understand Jane Mallor to be top in her field. But since this book is geared toward a non-law student - a business student, I give this book a 1, and a zero if I had the chance.

This book - textually speaking - is so poorly arranged. Key terms are imbedded in the text, there's no review at the end of the chapters, it's written in terrible legal-ease. "Down to earth" (non lawyer legal-ease) examples are difficult to come by, since most of the examples are actual cases that go on for pages (and they're "briefs"). To compound the matter, I spent $$$ on the study "guide" because the book is so unfriendly for studying. And guess what? The study guide has NO ANSWERS! What kind of a guide is that? How does that guide you? If you want it to be an "additional exercises" book, then call it that. But STUDY GUIDES ALWAYS have the answers. I hope your Prof. is better than the book they assign. "Business Law Today" is worlds better and easier to read and study, and better outlined and formatted for the "lay" person.

The book came in a sealed cover. Although it looks brand new, it does say it is "used". You would never know it. It came in a timely manner and when I followed up w/the seller to see when it shipped, they sent me back an e-mail within a few hours. I would highly recommend using Off Campus Athens again.
