Book Description

Nonprofit organizations face a special set of rules governing everything from how they charter their organization, to their methods of measuring unrelated business income, and how they lobby (and if, in fact, they should continue to be allowed to lobby).

Nonprofit lawyers, accountants, and directors need an easy-to-use reference work in understandable language to help them comprehend the issues and make informed decisions.

This core volume (ISBN 0471-196290) is supplemented annually.

4 out of 5 stars An excellent technical resource.......2001-04-26

The nonprofit sector is a huge part of the American economy. Nonprofits range from multinationals to your local little league. While, technically, the same body of tax laws applies to all of them, the level of sophistication varies as dramatically as the size of the nonprofit. And while the big nonprofits can afford to buy expertise, smaller nonprofits have to manage more of the tasks themselves. This book can help.

Hopkins' book is an excellent reference for attorneys and accounts and nonprofit executives with some knowledge of nonprofit tax laws work. It's not likely to be useful to and it's not written for the average volunteer. This is a fairly technical resource, and while nonprofit tax law gets a lot more complicated than Hopkins, this is a very good middle-level resource.

If I have any criticism of Hopkins it's this: in recent editions he has removed important subjects from this reference and spun them off into separate books at equally high prices. Most of the treatment of charitable donations, for example, is now in a different book. Private foundations are now in a different book. Excess benefits transactions are in a different book. You can spend a ton of money on Professor Hopkins. It costs him one star in my rating.

Even so, as a basic entry point, this book is indispensable. I've attended seminars by Prof. Hopkins and read most his books, and he is very knowledgeable and does a good job at the difficult task of translating IRS-speak into comprehensible language. This book should be a part of every nonprofit lawyer and accountant's library.

4 out of 5 stars Very comprehensive "hornbook.".......1999-08-13

In mid-1999 I read this treatise in conjunction with the author's one day course on the Law of Tax Exempt Organizations. The book is essentially a "hornbook:" a summary of law geared towards lawyers and accountants, rather than the casual reader. It would be especially helpful for lawyers and accountants in outside firms who counsel a variety of different tax exempt organizations and are confronted with questions of how to structure an organization or several related organizations. The material is valuable but no easy slogging, so if you can take the course (which in mid-1999 was approx. $230 and included the book), it would be worth the extra $70 or so.

5 out of 5 stars The single most important treatise on the law of nonprofits.......1998-06-09

US nonprofit boards, officers, senior managers, and funddevelopment professionals have enough to contend with without alsoracing to keep pace with the accelerating changes in the multi-faceted law of tax-exempt organizations.

As with his prior editions, Hopkins has managed to address, within the covers of a single volume well, actually, he added another book to more fully cover private foundations!

This is definitely a must-have book for anyone working for or with US nonprofit organizations, such as board members, officers, senior staff, fund development staff or fund-raising consultants, grantwriters, attorneys and accountants advising tax-exempt organizations, and anyone else requiring a single-volume treatise covering the law of tax-exempt organizations.

4 out of 5 stars Good Book for Start-Up Non-Profits.......2007-04-10

I found this book VERY helpful. In fact, I was so fascinated with it, I couldn't put it down. It was like a good novel. I immediately changed some of my thank you letters and re-did my Corporate request for funding letter. I will continue to use it's suggestions. The book is well written and not full of 'filler info', but very solid recommendations that one can put to use right away.

5 out of 5 stars A fundraising book for the small nonprofit, or one that is not well organized!.......2006-09-06

This is a great book for the small nonprofit that does not know much about fundraising. If it were for a more established nonprofit, then it would not have referred to major gifts as those starting at $500. I'm used to major gifts starting at $10,000 and going up well into the 6 figures.

This book explains how to do the following:

1. Work with individual donors
2. Plan special events
3. Solicit grants from foundations and corporations
4. Get media coverage (publicity)
5. Use the Internet to help in the fundraising process
6. Create print marketing materials like brochures, newsletters, and annual reports

All the above are important parts of a fundraising plan. One has to set goals, strategize how to attain the goals. Then attract individual donors and develop a rapport with those donors so they give more and more each year. Eventually those donors will become major donors, but that topic is best left for another book.

The book includes a good list of Web sites for prospect research. But the appendix materials didn't seem to be up to par.

All in all, this book provides grassroots strategies for struggling nonprofits. It is no-nonsense and well organized. I highly recommend it to anyone who wants to learn the basics about nonprofit fundraising. Topics beyond the scope of this book are planned giving, major gifts, capital campaigns, and endowments. But if you read this book and understand it, then you will be ready to learn about the other topics just mentioned. 5 stars!

5 out of 5 stars Clear and Simple Explanations of What Works.......2005-06-01

There are a tremendous number of non-profits around. There are also a tremendous number of funding organizations. Your job as the fundraising manager (whatever your exact job title may be) is to put your particular non-profit together with one or more funding organizations to raise the money you need.

There is a basic set of fundraising skills and technologies that you can use to fund nearly any non-profit. Gone are the days (in most places) where you can put together some simply fund raising activity and gain enough money to get you through the year.

Here in one simple book is an excellent summary of all of the most modern techniques. It includes:

Developing a Plan that will include your goal, the assets you have to do fundraising, and a strategy to use these assets in the most profitable manner.

Attracting Individual Supporters, which means making your organization look wupport-worthy, understanding your supporters and attracting new ones.

Your best supporters are those that have given you money before. Here are the techniques to keep them giving.

These techniques and many more are discused here by an expert in the field. It should be required reading for anyone responsible for fund-raising in a worthy organization.

Unlike other areas of fund-raising, planned giving brings fund-raising professionals into contact with lawyers, accountants, financial planners, consultants, and wealthy donors. They need to be able to speak the same language as the donors and their advisors while still keeping their own organization's goals in mind. This book can help them address these and other vital issues related to starting, marketing, administering, and expanding a planned giving program.

Private foundations are the most regulated of nonprofit organizations. Burdened with laws written over thirty years ago, which have become more complex and intricate, private foundations are forced to operate in a harsh legal environment. An operational or reporting mistake, no matter how innocent or inadvertent, can lead to immense tax and other penalties.

To reap the charitable, tax, and other economic advantages of private foundations while avoiding the perils lurking in the myriad of tax-law traps, you must be fully informed about the basic legal requirements and the many subtleties and current developments affecting private foundations.

Written by two of today's leading authorities on the laws regulating private foundations, The Legal Answer Book for Private Foundations provides this critical information in an efficient and comprehensible fashion. In clear, easy-to-understand language, the authors provide expert guidance on everything from how to set up a private foundation to how assets are invested, how funds are distributed to grantees, and how to avoid self-dealing.

You'll find answers to such critical questions as:

With the increasing opportunities for the establishment of private foundations, The Legal Answer Book for Private Foundations is an invaluable resource that is mandatory reading for anyone contemplating creation of a foundation or managing or advising an existing foundation.

      4 out of 5 stars Contemplating.......2007-03-23

Have been interested in starting an advocacy organization. This book is clearly written, appears to be authoritative and comes from a person who seems to care about the field. I finished the book mildly encouraged but with some respect for the complexities involved. Note that this is only about the legal issues of non profits, not "managing" non profits per se.

2 out of 5 stars Terrible source of outdated information.......2006-04-27

IRS Form 1023 is one of the most important pieces of starting a nonprofit organization. Yet this book, which is stamped with a 2005 copyright, contains information for the outdated, pre-2004 version of the 1023.

For example, the advice is given that one can attach a form SS-4 (request for EIN) with the form 1023, and in the form 1023 state "SS-4 attached" when it asks for an SS-4. Wrong. The IRS now requires an EIN be registered prior to submitting a 1023.

Likewise, the hints about "Part this" and "Question that" are completely out of sync with the actual application.

Grudgingly, I give the author credit for the other parts of the book. But 1023 is so important, that it would be terrible to let anyone rely on the information in this book.

A good source of detailed, up-to-date information on the 1023 is "IRS Form 1023 Tax Preparation Guide" by Jody Blazek. And I also recommend the companion book by the same author, "IRS Form 990 Tax Preparation Guide for Nonprofits".

Get those books. Do not get this book.

      5 out of 5 stars A Rosetta Stone for legally-challenged nonprofit trustees.......2004-04-30

I will begin with two disclaimers: I do not work for nor have any affiliation with the publisher, John Wiley & Sons, Inc (I am not a "corporate shill"). Notwithstanding that I would consider it an honor, I do not know nor have I ever met the author.

As an independent consultant providing philanthropic and nonprofit investment management consulting to the trustees of personal, fiduciary and institutional trusts, it is critical that I have expert resources available to provide timely and cutting-edge advisory.

I read voluminously, and my experience is simply this: in the world of nonprofit legal advisory, there is Hopkins, and everybody else.

I believe that success in any field of professional advisory is founded on specialization. This is another outstanding work by the pre-eminent legal expert specializing in advising charitable and educational organizations, associations, colleges, universities, hospitals, religious organizations, associations, and private foundations.

"Starting and Managing ..." is an essential resource in my nonprofit library; I recommend it to my clients as a "Rosetta stone" for translating the Byzantine intricacies of the Internal Revenue Code into a summary of the laws that affect the operation of nonprofit organizations.

If you have questions related to the establishment and qualification for tax exemption of nonprofit organizations, the establishment and operation of charitable fund-raising programs, and advice on matters such as public charity/private foundation qualification, the unrelated business income rules, and the involvement of nonprofits in partnerships and other joint ventures ... and need answers in non-legalese, rest easy: you have found your resource.

        Book Description

The nonprofit sector is a vital component of our society and is allowed the greatest freedom to operate. The public understandably assumes that since nonprofit organizations are established to do good, the people who run nonprofits are altruistic, and the laws governing nonprofits have reflected this assumption. But as Marion Fremont-Smith argues, the rules that govern how nonprofits operate are inadequate, and the regulatory mechanisms designed to enforce the rules need improvement.

Despite repeated instances of negligent management, self-interest at the expense of the charity, and outright fraud, nonprofits continue to receive minimal government regulation. In this time of increased demand for corporate accountability, the need to strengthen regulation of nonprofits is obvious. Fremont-Smith addresses this need from a historical, legal, and organizational perspective. She combines summaries and analysis of the substantive legal rules governing the behavior of charitable officers, directors, and trustees with descriptions of the federal and state regulatory schemes designed to enforce these rules. Her unique and exhaustive historical survey of the law of nonprofit organizations provides a foundation for her analysis of the effectiveness of current law and proposals for its improvement.

5 out of 5 stars Nothing like It!.......2005-03-29

The Good Corporate Citizen: A Practical Guide is a very detailed and complete handbook on corporate philanthropy for those corporations that that wish to make a meaningful contribution to the improvement of their communities, but it is extremely useful for individuals and family foundations that want to make a difference as well. Ms. Rubenstein has done an excellent job of raising the questions that donors must answer in this extremely complex area of philanthropy. And the book is just what the title says - it's an extremely practical guide with lots of examples and helpful detail.

        5 out of 5 stars A Handbook to Keep.......2004-09-25

What I appreciate about "The Good Corporate Citizen" is that it is an engaging blend of the very practical ("Why Conduct a Corporate Citizenship Program?" because among other things, customers "are likely to continue doing business with the company") as well as the ethical and near spiritual. In the latter category, eight steps on the ladder of charity are identified from the work of a medieval Jewish wiseman, Rabbi Maimonides. At the bottom level you can do charity with the zeal of Scrooge; at the top, you can help set up conditions such that people can avoid charity in the first place. Author Rubenstein deftly weaves modern-day parallels to all steps. The book is really a handbook in that it provides straightforward information on difficult subjects such as evaluating nonprofits on how they have made use of grants to providing a lot of useful sample forms on budgets, grant approval and "regret" letters as well as letters of agreement with recipient organizations and the basic elements of a corporate giving plan. Rubenstein also introduces new concepts, such as "social entrepreneurism" which is modestly revolutionizing approaches to making higher education more accessible to underprivileged groups in the US (www.collegesummit.org). She tantalizes with brief but insightful discussions on "quality of life" matters such as international and environmental philanthropy. One has a sense that she has much more to say on such subjects and, given the increasingly interdependence of the world in which we live, hopefully her next volume will treat these in greater depth.

5 out of 5 stars Navigating Your Corporate Philanthropy Journey.......2004-08-31

        5 out of 5 stars Multiple uses.......2004-08-27

We bought this book for our financial investments advisory firm, to create a good citizenship program; but we found that the information it contains is equally useful for some of our clients who are considering starting private family foundations. The lessons offered for most policy areas can apply for either kind of business: for profit and non-profit.

Hands-on guidance to help nonprofits through the tax filing maze

Forms 990 provide a wealth of financial and programmatic information to enable government regulators, funders, journalists, and the interested public to measure a nonprofit's performance. A copy of the forms must be provided to anyone who asks; charities' forms are now posted for public view on the Internet courtesy of Guidestar.org. These forms are the most widely used tools for evaluating tax-exempt organizations. Schools, health and welfare organizations, business leagues, civic associations, museums, parent groups, garden clubs, private foundations, and the myriad of other nonprofit organizations recognized under section 501 of the federal tax code must file this form annually. Clear, correct, and concise preparation of Forms 990-EZ, 990, 990-PF, and 990-T is important, not only as financial documents, but also as a means of communicating an organization's mission and accomplishment to the public.

Demystifying the Forms 990 for financial professionals and nonprofessionals alike, this user-friendly handbook walks you through the federal tax compliance process to assure maintenance of tax-exempt status. Blazek is widely recognized for her ability to translate complicated concepts into understandable language and explain the why and how Forms 990 should be prepared. In this book, readers will find:

4 out of 5 stars It's boring, but then, so is air and water.......2001-05-04

It's hardly the most sexy book I've reviewed, but it may be among the most useful if you are involved with a US nonprofit organization, or know someone who is. 990 Handbook is a line-by-line approach to the annual IRS Form 990.

Written by Jody Blazek, the book is a self-contained soup-to-nuts guide to completing these annual forms correctly.

Blazek accomplishes what she set out to do, as stated in the book's Preface: "My goal for this handbook is to demystify the Forms 990 for financial professionals and nonprofessionals alike - to make it easy for a nonprofit organization to achieve the best possible presentation of their financial activity and mission accomplishments for all to see."

As a lawyer who focuses on the law of tax-exempt organizations, one of my least favorite tasks is to prepare these annual forms. This handbook just made my life easier, and likely will result in a better result for my clients.
