    Probably the best product available. I bought the book plus CD. The book is very detailed and covers most topics you would want to know about in case you pass on. I feel I have a good understanding of the process. Estate planning is somewhat complex and takes time. You must read the book before plugging in the software so you will understand the major decisions you must make.

    This package will crank out straight forward, no nonsense wills and related paperwork that is valid and binding. You do not need a lawyer. However if you have anything complicated or involves many conditions, you better pay the lawyers fees.

    I have not used all the pieces of this and it has some limitations but it is a cheap way to get a will I guess. I am mostly annoyed that they don't make it for Mac which makes it a bigger hassle for me since I am a Mac user.

    My wife and I bought this product before we went on an out of the country vacation and left our toddler with relatives. We wanted to have the peace of mind that our intentions were documented and known. Our situation is not complex so we found the program and documentation to be very accommodating.
    I would guess that someone who had a great deal of acquired wealth and assests, or a complex family system may want to invest in an attorney's assistance.

    WillMaker was simple to use, and didn't take much time at all. It is a great way to get your affairs in order. It's not easy to think about death, but I think it is important, so those who survive you don't have as many difficult issues around one's death.

    This program also has some other useful legal programs such as childcare contracts.

    I didn't want to go to a lawyer and spend lots of $ on the very little money I have. The software comes with a very detailed book and explains everything very well. I did actually write my will that day and living will as well.I just have to get it signed by witnesses and notarized. I didn't give it a perfect 5 b/c there is no such thing as perfect. That's just my own opinion. Well worth the money and the software goes through the will process step by step.

    This is a wonderful book on estate planning that focuses on legal and practical issues. I loved it. As I read through it I did not see any inaccuracies in the law or in the subject matter. I especially enjoyed reading about the different options one has regarding how to leave property to minor children. And it includes a thorough discussion on the ways to save on estate taxes.

    This book is written for the nonlawyer. And it is not designed to cover in detail ancillary subjects related to estate planning. It is applicable to all states (except Louisiana) and DC. It will be useful for people with estates of any amount. But because of its comprehensive nature I seriously doubt that people with insignificant estates will want to read it. There are other less comprehensive books those people should read. There is no reason to get overwhelmed about estate planning when there is no need to do so.

    This book does not provide prepackaged estate plans to be used as templates for readers. Subjects not covered are elder law, retirement planning, and financial planning. However, I think Chapter 13 concerning Retirement Benefits came pretty close to being a superficial chapter on retirement planning.

    I would have liked the book better if chapters 3 and 10 had been combined. And I realize that most estate planning authors include retirement planning and incapacity planning in their books. But I view those subjects as being separate and apart from estate planning and should have been left out of this book. Ergo, I'd get rid of chapters 13 and 26. Maybe they could be the subject of another Nolo book? The coverage of state law exemptions regarding probate seemed out of place to me, too. I don't think the intended audience of this book really cares about that material.

    My favorite chapters were 15 to 23. Understanding estate and gift taxes and how to reduce or eliminate them is what estate planning is mostly about. And it was wonderful seeing Chapter 22 (Disclaimers) and Chapter 28 (Small Business Owner issues). These subjects are ignored in most estate planning books.

    I thought the author went a little heavy on being anti-Probate throughout the text. Probate has its good points and its bad. I would have liked the book better if the author had just stuck to the facts and not gone overboard giving his slant on the topic. 5 stars!

    Extremely helpful for the lay person. My mother introduced us to an older edition. She was ahead of her time with the living trust idea. Even though I would eventually use a lawyer, this helps you know the right questions to ask.

    Let's face it, this stuff is complicated, and pretty much meant to keep lawyers in business. Get this book as a reference and be able to answer a lot of the questions on your own.

    2 out of 5 stars Nearly useless if you have retirement accounts.......2007-02-15

    I bought this book prior to seeing an attorney to set up a will/trust so that I would be reasonably knowledgeable about the issues to consider before the meter started running. In particular, I, like many others have much of my net worth in IRAs and other tax advantaged retirement accounts and was concerned about how best to pass on these accounts. To my utter astonishment (and disgust), this book for all practical purposes provides no help with IRAs, 401Ks, etc. For heavens sake, after a home, retirement accounts are the major assets of most people and an estate planning book of 443 pages ought to be able to squeeze in basic advice on this topic.

    Actually, I'm exagerating; they do provide two pieces of advice on IRAs. Their advice on page 179 is to buy a separate book from Nolo Press (whose title I will NOT cite) and on page 181 they suggest you download publications 560 and 590 from the IRS. Gee thanks. You don't suppose they intentionally omitted retirement accounts so you'd have to buy another one of their publications? Could I be getting cynical in my old age?

    If you don't have IRAs this book is pretty good (reason for two stars), otherwise you 're flying blind.

    In order to help my parents with their trust, I had checked out about a dozen books on the subject from the library. I found Denis Clifford's to be the easiest to follow and easiest to read on a fairly complex subject. I found the book (and his "Plan Your Estate" book) so informative I bought a set for myself.

    This book offers lots of "real life" examples of different types of financial scenarios and the best options for setting up a trust that will protect the assets from excessive legal fees and/or estate taxes. It covers almost everything you need to know to either write your own trust or carefully check the details of your trust if prepared by a lawyer.

    The CD included provides you with the language you need to write your own by filling in the blanks, as well as the step-by-step procedure to cover all the bases to be certain the trust meets all the legal & tax requirements for trusts.

    This book is also apparently updated each year, as the tax and estate laws are frequently being revised. I highly recommend this book, and also highly recommend as a companion book that covers other aspects of financial planning, wills, etc., Dennis Clifford's Plan Your Estate.

    I was so impressed I also bought copies of both books for my parents and my sister so we could all get our finances in order.

    Nolo Press continues the tradition of providing step by step guidance through complex legal processes. Step by step demystification of the process.


    Even if you are going to use an attorney this is a good read and you will save many times the cost of the book in having answered your own questions and by receiving a good introduction to the subject.

    I am an attorney (shyreslaw.com) and I highly recommend this book for those who could use a simple trust and want to avoid probate. Even if you decide to hire an attorney, this book is invaluable because it offers great insight into trusts and avoiding the probate system.

    Attorney Denis Clifford wrote this great do-it-yourself book which provides everyone a way to create their own simple living trust. A CD-ROM is also provided so you can easily input your information and print it out.

    For a more complete estate plan, the book introduces the importance of pourover wills in case the trust fails to encompass all the property. You may want to peruse Mr. Clifford's Simple Will Book as well (another recommended buy).

    This book was a god-send! I was skeptical at first because I have no legal backround and I thought that making my own living trust would be complicated at best, impossible at worst. But following a recommendation of a friend I decided to give do-it-yourself law a shot. Boy am I happy I did! I saved a fortune in legal fees and was able to get the job done just as well as if I'd had a lawyer coaching me every step of the way.
    Make Your Own Living Trust was easy to use and very accessible. It even has all of the forms you'll need on an enclosed CD-ROM. Thanks to this book I was able to transfer assets such as stocks, real estate and jewelry to my trust, appoint someone to manage the property that I'm leaving my children, and keep control over it while I live. So don't be afraid to do it yourself, you'll save money and get your trust done the way you want it!

    The ABA should be ashamed. This is not a book designed to inform but a list of reasons to see a lawyer. Interested in software to help. They cover that topic saying "since lawyers generally charge less for less complicated estates, you may be able to gain the benefits and flexibility of real legal advice for little more than the cost ofa computerized will kit." They let you know that "many alternative estate providers fail to inform you when there may be abetter (or cheaper) way to accomplish your goals" implying that the infallible lawyers always do so.

    Want to use a statutory will - they'll tell you why you should use a lawyer instead.

    Interested in learning about benificiary deeds they tell you "Your lawyer can explain the ins and outs of your state's law relating to beneficiary deeds."

    How about this gem from page 44 "...should be coordinated with your estate plan, preferably with the assistance of your lawyer."

    Or this one from page 46 "Check with your lawyer to see whether your state permits this arrangement and whether it's a good idea for your situation."

    Want a well crafted will? Your infallible lawyer can help "craft your language so that no ambiguities remain that might invite a court challenge. Your lawyer can help you do that."

    Don't ask practical questions, like which states allow statutory wills, those aren't answered.

    This is an excellent book. It answered all of my questions about handling my estate, and it answered many questions that never occurred to me. The writing is straightforward and easily understood. The title is THE AMERICAN BAR ASSOCIATION GUIDE TO WILLS AND TRUSTS, but it covers a good deal more: steps to help your family now; estate plans; avoiding or reducing estate taxes; transferring property without a will; securing long-term care help; and many other topics relating to managing your estate and passing it on to your heirs. This is a very useful book.

    Don't be a sucker. The ABA is not going to help you understand the probate or non-probate system. I have been a lawyer for over twenrty years, and I can't understand what they are trying to say. They want you to give up rather than understand the tools of estate planning. I am the author of "Everything A Baby Boomer Should Know -- An Insider's Guide To Estate Planning." Compare it to the contents of this ABA book. The difference is that the ABA book is nothing more than another textbook that speaks over your head. Read my book and truly understand how the system works for you. I promise.

    This was not the first estate planning book I bought, but it was the best. Without dumbing the issues down, the author carves out manageable modules to make each chapter as clear and understandable as possible. The book features anecdotal paragraph case studies based on real-life examples to flesh out the major points. In contrast to more encylopedic approaches, and as part of the NOLO series, this book is for non-lawyers. It makes clear that estate planning is about how to avoid probate and how to arrange for the conveyance of your assets to your heirs. That is, estate planning not about tax sheltering per se. Obvious, perhaps, to a lawyer, but not to most people. Another strong point is the clear and cogent explanation of trusts. A trust is a written agreement that defines the relationship among the grantor, the trustee, and beneficiaries. Here as well, the book delivers big-time by rendering legal abstractions accessible to the general reader. What a great service!

    If you have ever embarked on a mission to get your affairs in order, or to help someone get theirs in order, you know how daunting the task can seem. I bought three other books prior to this one, and wish I would have started here. The other books are vast in their expertise, but are too complex for someone getting started. This book is the perfect place to start if you want to gain knowledge about estate planning prior to either making your own will (and/or living trust), or prior to going to see a lawyer for his or her help. This book explains the essentials in simple English. It truly delivers on its sub-title, "What you need to know & nothing more".

    p.s. If you are going the do-it-yourself route, I recommend that your second purchase is Quicken WillMaker 2006.

    This is the best book out there on Estate Planning Basics. Armed with this book and Quicken Personal Lawyer I was able to do our living trust, wills, life insurance and other estate planning documents and save the legal bills. Even if you end up using a lawyer, you should get this book first to get informed.

    This book provides an easy to understand overview of estate planning plus easy to understand detail on many special circumstances. It is very easy to understand which estate planning techniques are right for you, and there are many examples that illustrate how the techniques work. Approximately half of this book is relevant to everyone. The other half gives clear, common sense explantions of advanced planning techniques that are typically reserved for those fortunate enough to be planning a high net worth estate (lets say $1M+). The advanced techniques are not for do it yourselfers, but the book gives you a good understanding of the issues and lets you converse intelligently with an attorney.

    We were hoping to set up a will and living directive, but the CD didn't have that. The forms are in PDF format so you print them off and fill them out?? Not sure why that is, deliver a Word doc so people can type it in. It's a great get all the information together type of book, just not great on the other parts of what to do if you become incapacitated type situations.

    I bought this book thru Amazon in June 2006 because of my experiences working with a close friend who had just lost his father rather unexpectedly. My friend faced a monstrous task of trying to track down his father's assets, business records, last will, credit accounts, etc. just to scratch the surface. As a participant in his frustration, I began to think about the arrangement of my personal life and how my loved ones would tend to my estate.

    "Get It Together" brings so much to the table to deal with. I think most people refuse to face their mortality and the task of making such arrangements, let alone there really is a large volume of papers, decisions, conversations, and organization to be handled. GIT is very thorough in all topic areas (see Table of Contents). The book discusses the emotions involved with each topic area, numerous websites to obtain additional information, what to get a copy of, keeping the info current and arranging your "estate" or life, for that matter, to benefit those close to you.

    My parents or other people I look up to would never or be highly uncomfortable discussing these topics in detail. This book is perfect to compensate for the lack of those conversations. Now, just a warning for those willing to purchase and conform to this book. I was quite diligent in following all their instructions and recommendations to the "t". It took longer than expected, about 12 weekends, until I had gathered and organized everything to my satisfaction and I don't have a wife, kids or other complicated situations...just me alone.

    But I have such a peace of mind that my successors will have no trouble making decisions or tracking down stuff because it's all there with explicit directions from me. I find going forward that I try to keep my life organized in a simple fashion and refuse to take on unnecessary stuff that I will need to add to my planner. And I feel no stress at all looking at my desk now because all the meaningless clutter is gone and GIT was a big reason for that.

    Finally, the greatest resource is the forms CD included with the book, which saves a great deal of time when the organizing process starts and got me unstuck in some areas.

    This guy appears to be pushing some fairly common stuff like family limited partnerships. I wasted my money buying his book. Nothing earthshattering or creative about his structures. They put "JD" after his name and not "Esq" does that mean he never passed the Bar exam? I found that by simply searching for asset protection on Google you can find a lot of law firm and other websites where you can learn about all these strategies for free.

    I found this book very easy to understand and informative. I have attended estate planning seminars and other financial conferences, but came away overwhelmed and confused. Jay has a great personal story that really adds to his credibility. After I finished reading it, I immediately read it again. I know what to do and what not to do. I have changed the way I do business since I read this book.
    The negative review by "Cool Cat" is obviously biased if you read all of his reviews. He only endorses one asset protection book and it's probably his own. My guess is that he never read any of these books and is eihter Jay Adkisson himself or one of his associates. Notice that his review doesn't focus on the book, but rather attacks Jay Mitton. This seems typical for most attorneys.

    I have read hundred of books on finances and I would rate this book near the top as to its usefulness. I learned more about asset protection from reading this book than I have learned from the hundreds of hours I have spent with CPAs, attorneys and financial advisors over the years.

    Among his estate planning peers, Jay Mitton is one of the least liked and most notorious attorneys because of his heavy marketing of arguably worthless pre-made kits for family limited partnerships. The low quality of these kits, combined with Mitton's less-than-truthful marketing, has generated some scathing comments on the American Bar Association's estate planning bulletin board. The Supreme Court of Florida in fact entered an order prohibiting him from marketing in that state. The guy is a great marketer, to be sure, but his products can be charitably described as substandard and if you buy his book you need to also buy a ton of salt to go with it.

    In most communities, land use regulations are based on a limited model that allows for only one end result: the production of more and more suburbia, composed of endless subdivisions and shopping centers, that ultimately covers every bit of countryside with "improvements." Fortunately, sensible alternatives to this approach do exist, and methods of developing land while at the same time conserving natural areas are available.

    In Conservation Design for Subdivisions, Randall G. Arendt explores better ways of designing new residential developments than we have typically seen in our communities. He presents a practical handbook for residential developers, site designers, local officials, and landowners that explains how to implement new ideas about land-use planning and environmental protection. Abundantly illustrated with site plans (many of them in color), floor plans, photographs, and renditions of houses and landscapes, it describes a series of simple and straightforward techniques that allows for land-conserving development.

    The author proposes a step-by-step approach to conserving natural areas by rearranging density on each development parcel as it is being planned so that only half (or less) of the buildable land is turned into houselots and streets. Homes are built in a less land-consumptive manner that allows the balance of property to be permanently protected and added to an interconnected network of green spaces and green corridors. Included in the volume are model zoning and subdivision ordinance provisions that can help citizens and local officials implement these innovative design ideas.

    Check out some of the final subdivision design parameters on page 87. While other reviewers might benefit from the author's justified concern for conserving open space--especially in communities where cookie-cutter style developers 'rule the Board', the end result for some of the plans in this work APPEARS to be large-lot American sprawl, with ecological considerations that don't go far enough. Perhaps Arendt's GROWING GREENER, which I've not seen, will get us closer(?)

    What a concept! Rather than trying to get the most acreage per lot, make smaller lots with more shared open space. A must read for every developer, planning board, and zoning commition. Easy to follow examples show how to preserve historic and environmental features while adding to the value of the land that is developed.

    If we developed land in the manner the author teaches, America would look so much nicer! A very common sense approach to maintain rural character in an area and stop sprawl from destroying your area. Every developer, planner, new home buyer, builder, conservationist and private citizen should read this and also buy the author's book, "Rural By Design".

    Cheers for Randall G. Arendt, et al. For years my government agency has been fighting a loosing battle in Florida with unmanaged and unfettered urban growth. It seemed as though nothing could stem the tide of urban sprawl until two things happened. One was an election of a more centralist government and the other was the introduction of "designing for conservation" into our policy making levels. This concept was brought into clear focus by Arendt's book. The authors not only presented a practical and economically sound guide for growth that can benefit developers, but the reference can act as a mechanism to help preserve the environmental cohesiveness of any community. The policy makers in our community were so impressed with this book that fifteen (15) copies were purchased to be placed into the hands of influential politicians, developers and regulatory agencies.

    As a land developer this book brought into focus the problems that haave been growing as more and more of the land in my area has been consumed, and we have less and less to develop. At first I thought it would be another environmental tirade against land development,but instead realised it was a very practical and economically sound guide for development that would benefit me and also help maintain the character of my community. Arendt's concern is for the environment and the preservation of open spaces and connective corridors of space and natural habitat between differing parcels of land in a given area. His solutions achieve these goals, but of special interest to me as a developer is that his solutions also mean no loss of density, reduced costs and higher land values. Excellent illustrations, easy to understand and worth the price many times over.

    Have not had a chance to read cover to cover yet, but it looks very well written and organized so far, so that any normal person can absorb and understand. Wish this was the required text for my class. No doubt it will probably fill in the gaps that my real text missed, since this book seems more grounded in reality, than textbook theory. It may not help me on the test, thought I'm sure it will; but I'm sure it will help me in real life.

    As a development officer for a prep school, I was looking for a book that would give me a birds-eye view of issues involved with estate planning. Steve Mapleýs The Complete Idiotýs Guide to Wills and Estates does this masterfully. And, to my relief, in plain English. Impressive for an attorney thatýs taught and practiced for the over 25 years!

    In very easy-to-read language, Maple thoroughly lays out the whole terrain of estate planningýfrom having a will to ways to save on current taxes and issues to consider in caring for aging parents. Going beyond mere explanation, heýs packed this book with helpful forms and lists to get the reader started in their own estate planning. I picked up this book to help me with my conversations with donors but I ended up sitting down with an attorney to work on my own plan!

    Maple groups his 24 chapters into five sections:

    Part 1: Assets, Assets, Assets
    Part 2: About Wills, Trusts. . . and Probate
    Part 3: All in the Familyýand Just a Little Beyond
    Part 4: Taxes You Must Pay, and Those Maybe You Donýt

    The structure of The Complete Idiotýs Guide to Wills and Estates makes it a great book for busy professionals. Itýs very easy to read in short chunks of time. And itýs not just for the beginner. Although itýs now somewhat dated, Maple gives some pretty technical examinations of taxes and IRS regulations. For readers that way find themselves losing interest during the dryer technical sections there are tips, quotes, and anecdotal information interspersed throughout. As a development professional, I was particularly glad for Chapter 18 ýHow Charitable Donations Can Save You Money.ý Iým trying to figure out how I could make this chapter required reading for prospective donors.

    More than any planned giving seminar Iýve attended, and for a lot less money, The Complete Idiotýs Guide to Wills and Estates has helped me see estate planning from the donorýs perspective. I highly recommend this book.

    I'm a big fan of the idiot's guides since they are always clear and easy to follow. The authors do an excellent job of explaining complex terms and concepts so even an ordinary person can understand the reasons behind drafting a will. After reading this book, you'll see that you'll want to do everything you can so that you do not find yourself "intestate" -- then the state fights over what belongs to whom. Although it's difficult to think about dying, it's even worse to think about having all your money thrown to taxes or tied up in court as relatives fight. Prevent this ugly mess by learning the basics of wills and estates. I should add that this book goes well beyond the basics -- even a millionaire could learn a few good tips from this excellent book.

    Excellent source of information for anyone who doesn't have a clue where to start. Easy to read and packed with hints. Motivating little scenarios to keep those of us who have been procrastinating in motion. Both my husband (who this was all new to) and myself (with a background in accounting) found it to be useful.
