    4 out of 5 stars leading to civil war?.......2006-03-16

    The book's essays study an often cruel paradox. Why do some developing countries with valuable natural resources descend into civil war? The answers are manifold, with the foremost amongst these being described here.

    A prominent factor is that the resources give something to fight over. Be these diamonds, opium or oil. Mix this with the presence of different regional or ethnic groups. Then add a propensity for corruption in the central government, and have that government dominated by one group. Often, all this leads to the government's functionaries siphoning off much of the wealth derived from the resources. Leading perhaps to civil war.

    The essays explore how these factors have played out in various countries; mostly in Africa. A depressing read. What is striking is how often the central government proves so reluctant to even spend some money for minimal development across all the country's regions. It's not so much that corruption exists, but the sheer level of corruption, that impoverishes the entire country.

          To what extent should public services (for example public utilities such as telecommunications, energy, public transport and postal services) be subject to ordinary competition law? This question has assumed great importance in the context of the activities of European Union. On the one hand, it is argued (particularly in France) that competition law is a threat to the values of public services that underlie their distinctive objectives. On the other, the 'Anglo-Saxon' argument is that protecting public services from competition gives them an unfairly protected position and can mask their inefficiencies. This book examines the philosophical, political, economic, and social principles involved. Prosser contrasts the mainly economic and utilitarian justifications for the use of competition law with rights- and citizenship-based arguments for the special treatment of public services, and examines the varied conceptions of the differing traditions in the UK, France, and Italy. Prosser then considers the developing European law in this area. He examines decisions of the European Court of Justice, considers the development of the concept of 'services of general interest' by the Commission, and reviews the liberalization process in telecommunications, energy, and postal services. He also provides a detailed case-study of public service broadcasting. The book concludes by drawing general principles from the debates about the extent to which public services merit distinctive treatment and the extent to which competition law must be amended or limited to respect their distinctive roles.

            For several decades after the UN Charter insisted that the promotion of development and human rights were central to post-World War II conceptions of world order, the two fields remained in virtual isolation from one another.               This is a necessary tool to every person, not only to lawyers, interested to know how the "personal data protection" works in the European Union. You will be surprised with the similarities between the privacy regimes in Europe and the United States, notwithstanding this systems differ in important particulars. The book includes the study of the ways in which restrictive data protection law may clash with free trade agreements signed by the US and the members of the EU, as the World Trade Organization. The book is highly recommended.

                The Contract is the core tool of governance in a free market economy. An EU Contract Law Code is now on the political agenda because all three legislative bodies in the EU and most member states favour it in principle. In its communication of July 2001, the Commission proposed three major options: to enhance the existing EC Contract Law by eliminating inconsistencies; introducing a European Code which substitutes national laws; and introducing a European code which only supplements national laws.
