Book Description

Beginning with the basic laws that govern photography, this legal manual helps photographers understand the basic matters of access and privacy, covering issues such as shooting images on private property, consent, and the photography of public groups. Subjects addressed include the legalities of photographing currency, stamps, securities, trademarks, seals, and insignia; military and nuclear installations; copyrighted materials; children; and animals. This updated handbook closes with a helpful glossary that decodes complicated legalese.

3 out of 5 stars little disappointed.......2007-03-18

I'll admit I haven't read every page of the book yet. I'm using it more for reference than anything. But so far I haven't been able to find much in the book that isn't already general knowledge in the photography community. Great for a beginner, I suppose, or someone just starting out. I'm just a little disappointed that I didn't find more valuable detailed legal information in there to help me in my stock photography business.

5 out of 5 stars Your Questions Answered.......2007-01-24

As an advanced novice taking the first steps to go pro, I had a LOT of questions about legal issues of photography. I'd searched for some of my questions online and in a few books, but the answers were never good. They either focused on different questions or didn't give enough of an answer to satisfy me.

When this book arrived, I flipped through it and read all of the photo captions. Wow! Immediately I saw its value. Then I started reading through sections of the text. It answered all of the questions I'd had.

While one would best be advised to contact an attorney if a legal issue came up, this book goes a long way to help the reader avoid legal problems. I am VERY satisfied that I bought this book. If you're a professional photographer with legal questions, I'd highly recommend it.

4 out of 5 stars Quick and to the point........2007-01-10

This particular book is almost like a "Cliffs Notes" version of some other more in-depth books on the same subject matter. In that regard, it is a great reference guide to have in the event that a specific question comes up about legalities faced by still photographers when it comes to usage, copyright, privacy, etc. A great book and I recommend to anyone who has questions about certain subject matter when it comes to still photography.

5 out of 5 stars Great Advice and Cheap Insurance.......2007-01-07

As a professional photographer and writer for many years, I have occasionally bumped into problems related to making or using photographs -- people who tell you that you can't make a photograph, people who use your photographs without permission -- and I found Bert's first edition of this book several years ago and was delighted with its contents. His model-release form, for example, is the most simple and un-intimidating I have ever seen, and getting a signed model release is required for some of the work I do. I thought the advice generally was superb -- so much so that I bought copies of the book for everybody in our little company.

Since then we have worked with Bert on many copyright infringement problems, always successfully, and some of that experience has been incorporated into this second edition of the Handbook. There is tremendous misunderstanding about how the Copyright Act works and what a photographer must do to get full protection -- formal registration -- and what a photographer can get when a registered image is infringed. Bert knows this topic inside and out and shares that information in this book.

If you are a photographer who plans to keep from being sued, arrested, or harassed, and if you want to know what your options are when somebody uses your work without permission, Bert's LEGAL HANDBOOK is great advice at very reasonable expense. In fact, it is worth it for just the model release alone!

5 out of 5 stars If you're turning pro, you'll want to read this book, too........2006-11-05

After jumping into the digital world and actually selling my images, the thought occurred to me that perhaps I should learn a few things about protecting my rights and respecting the rights of others. That is, I wanted information about how to cover my legal backside.

Krages' book describes a U.S. photographer's rights and responsibilities using a clear and conversational prose. While he explains the legal jargon specific to photography, he never forgets his readers care more about making photographs than reading dry law books. The book includes a great breadth of information in modest depth. I really appreciated the sample forms.

Given that I'm a novice pro, I found this book extraordinarily helpful. If you're turning pro, you'll want to read this book, too.

5 out of 5 stars Another John Shaw Book - Excellent.......2003-02-04

This is another of John Shaw's excellent books on photography. Liberally illustrated with examples and interspersed with his commentary and notes I found tremendously useful.
Shaw covers almost all aspects of photography - from the rule of 16ths, exposure, film, tripods, lenses, closeups, depth of field, composition, backlit photography, etc... Reading this book before you start using that brand new SLR of yours will save you a lot of frustration and trial and error:) A lot of the tips in the book are also equally applicable to people using point-and-shoot cameras also.
A very useful feature in this book is that almost all photos have exposure details listed. Some of his other books do not have these details, which I miss.
This book is highly recommended if you are just beginning photography and are looking for a good introductory book.

5 out of 5 stars a must read for beginners and advanced amateurs.......2003-02-04

It's usually difficult to write a nature photography book that's useful for the beginners and at the same time gives valuable advice to advanced amateurs, but Mr Shaw has just done that in this book.

This book contains very valuable advice for advanced ones especially on close-ups and flash photography and at the same time he covers the basic rules (thirds, sunny f/16) from an interesting perspective. I found his advice about filters and field gears invaluable.

Read this book if you want to take stunningly realistic nature photographs.

5 out of 5 stars GREAT REFERENCE. WELL ORGANIZED.......2000-07-27

I doubt if this is the only book that you will ever need on this subject, but it is certainly one that you should not be without. I frequently use it as a quick reference/refresher before "going on a shoot." The topics are organized into 2-4 pages each that provide a lot of explanation without getting bogged down in chemistry and physics. Lots of great photos to illustrate the major points.

4 out of 5 stars A great first book for the aspiring nature photographer........2000-03-02

John Shaw's books are highly recommended by many photography enthusiasts. I bought his "Closeups in Nature" last year, and thought it was one of the best instructional books on photography I've ever read. "Nature Photographer's Complete Guide..." is also a very good a book, I think, but I wouldn't buy it if you already have the "Closeups..." book. I think it is probably better suited to beginning photographers.

3 out of 5 stars Good across most areas.......2000-02-25

This book touches on many relevant areas and facts about landscape and wild life photography. Good reference material. A little brief about composition in the area of landscape photography, though.

1 out of 5 stars Vanity publishing.......2007-05-13

I was immensely disappointed by this book. It seemed to promise so much depth and insight. It is structured as a conversation/interview between two knowledgeable photographers; but we quickly discover that one is an unashamed acolyte of the other. The text quickly degenerates into a fawning, vacuous, name-dropping style to which the authors are apparently habituated. There's no information, no insight, no inspiration and no intellectual courage. I burnt it.

5 out of 5 stars For those who love photogrpahy.......2005-09-26

This is written for lovers of photography. Not only does it discuss the romance of camera and film, it has good information, it is motivating and it reminds those of us who have developer, stop and fix in our veins why we fell in love with the art.

Motivating, educational and a good read. Don't miss this one.

5 out of 5 stars "Must Have" Book.......2004-06-13

This book is a "must have" for anyone who is serious about becoming/being a photographer. The majority of the discussion relates to the creative process, with a small amount of discussion of equipment and technique. I bought my copy (third edition) direct from LensWork for US $12.95.

5 out of 5 stars A Classic Exposition! Buy it!.......2003-02-19

Upfront, I want to say that this is an OUTSTANDING book!

Any self-help book makes assumptions about what hang-ups the reader is dealing with. It sometimes happens that a book is useless to a given reader, because he is so perfect he has already transcended the problems the authors deal with.

But for me, the authors of "On Being a Photographer" precisely target the questions I have struggled with.

Just to name a few (addressed in this book):

1) Yeah, subject IS more important than technique!

2) Am I the only one to shoot reams of film and never quite get the perfect shot?

3) Does luck has a lot to do with it? But can I make my own luck?

4) Exactly HOW does a top photographer approach taking the single picture?

(And much more!)

Since this book has no photographs, it is very reasonably priced. It is not very long, but neither is the Constitution of the United States.

Both authors spent some time in academia, and there is a certain amount of high-toned discussion, but they cut rapidly to the core principles. Stylistically, there is a bit of the mutual admiration society, but this serves the question and answer format that reinforces the classic points they make. I have found that the concise chapters aid easy rereading of specific topics in coffee shops or chores like jury duty. I will reread this book many times.

Since this book has no photographs, it is very reasonably priced. It is not very long, but neither is the Constitution of the United States.

David Hurd's core experience base was back in the classic days of Magnum, which may be a problem for some who may feel that nothing important happened before they were born some sixteen years ago. But a camera is still just a box, whether you are using a Leica M3 or a plasma camera in the thirty-watt range. And single images are as powerful as ever.

This is a great book. Buy it. Read it. Read it again.

Customer Reviews:

5 out of 5 stars Insightful.......2007-01-10

Although no book is meant to take the place of an actual attorney when it comes to specific legal matters (as this book prefaces with a disclaimer inside the front cover), this particular book takes an in-depth look at many different legal scenarios involving still photographers. It also gives detailed references of case logs for each legal scenario presented. I found the book to be very useful at anwering questions of an ambiguis nature when it came to certain legal aspects of copyright, usage, contracts and privacy, etc. I highly recommend this book and it is something that every professional photographer such as myself, should have on thier shelf at home.

5 out of 5 stars A basic survey of photographers' rights and obligations.......2002-08-08

Digital imaging and the Net offer both new markets and legal challenges for photographers: Leonard Duboff's Law In Plain English For Photographers provides a survey of the rights and responsibilities of modern photographers, covering the latest rulings for copyright and trademark law, surveying contract structures and leases, and providing a host of everyday business and legal concerns. An excellent, basic survey of photographers' rights and obligations.

1 out of 5 stars Definitely overpriced..........2007-08-29

This book looks like a do-it-yourself publication. Certainly not worth this price. Anything by Freeman Patterson would be a better choice, both for content and value for the money.

5 out of 5 stars An Incredible Journey with a Master Photographer.......2007-03-17

This book contains essential information having been written by an incredible Master Photographer. An absolute must read for both the novice and experienced photographer as Klaus Bohn is the very best educator on this subject. Hopefully this will be the first of many books written by Mr. Bohn as I want more for my own library. I am drawn to his warm personal style evident in both his written work and in the amazing photographs he has taken. Highly Recommended!!

I expected a useful treatise by a respected photographer. Instead, I received a book that is so poorly written it appears it had no editor, with illustrative photographs so poorly reproduced it is hard to appreciate what they are demonstrating. Save your money and look elsewhere for help.

3 out of 5 stars A Good Resource.......2006-10-23

Photographers need to know the principles in this well-written and straightforward book. However, it has not been updated in some time, and the laws do keep changing in this area. It might be good to find something more up-to-date to rely on as a resource.

5 out of 5 stars Ignorance is not helpful.......2005-09-29

Matters of law are usually best left to attorneys and alike. It makes perfect sense to have some basic knowledge before entering any type of business. I really enjoyed the manner in which this book is organized. The straightforward approach of this book is much appreciated. A must read for anyone who wants to take photos beyond family gatherings.

5 out of 5 stars A must for any citizen with a camera.......2005-05-21

Krages has done all of us a great favor by writing this book. Taking pictures is NOT a crime, and as long as you're on public property, you can photograph just about anything. Knowlege is ammunition and all photographers should know their rights.

This is well written and illustrated with photographs by the author. It is written for the layman and contains a glossary of legal terms.

And Krages is a good guy. Just because one has a legal right to photograph something, he writes, doesn't mean we should, for ethical reasons.

Put those security goons and pushy police on notice - You know your rights!

5 out of 5 stars Great reference tool!.......2003-08-12

Great book to have on hand to take notes from and to reference when needed.

It touches on all topics re: liability and includes a great resource section.

5 out of 5 stars A Practical Guide to Dealing With The Public.......2003-02-08

Everyone who takes photos in public places should have a copy of this book. Krages points out that laws restricting the publication of photographs are different from laws about making those photographs in the first place, and many misconceptions are the result of confusing the two. He also has some good suggestions for staying out of trouble, how to deal with confrontations if they occur, and when to call a lawyer. He writes: "Confidence in knowing one's rights is important when photographing action on the streets but knowing how to avoid upsetting people can be more important." He says that most lawsuits are the result of emotional issues rather than a desire to collect money.

If you want an extended discussion of copyright law, look elsewhere-- this book is about *taking* photographs, not publishing them. Good information and advice on every page.

5 out of 5 stars The perfect level of detail for a beginner.......2007-06-12

This book covers all the main topics of wedding photography for the beginner. Not too much detail on camera settings; the focus is more on things you want to be aware when photographing the different parts of the wedding from before the wedding until after the reception. Pictures are great as examples and text is easy to read and understand.

2 out of 5 stars Only for film photographers.......2007-05-19

I got this book hoping for info geared for digital photography, it has none. The book was written when digital photography was just becoming popular. It is good for formal wedding posing ideas, but it gives no technical info for digital photography. All of the info is based on using film.

3 out of 5 stars Overrated.......2007-04-29

I am a beginning photographer but after having reviewed Digital Wedding Photography by Ken Johnson, this book I would say is a distant 3rd. Overall the book is well very simple, well written but low on explaning tecniques. This book dealt with more emphasis on wedding workflow from the dressing room to church and beyond. As a photographer I think we all know that already....I would have been happy if emphasis was put on techniques and tips on how to capture the moment. If this was my first book I may have been impressed with it but sorry folks Ken's book is far more superior in quality overall.

2 out of 5 stars Not rocket science.......2006-07-31

I was hoping for a book that offered some real value - an easy to read, quick to digest volume that provided some real insight. But this is basic content that may be of value to those who have never taken a picture before, most likely using the "professional techniques" verbiage in the title to attract more buyers. It certainly got me!

4 out of 5 stars Great Reference.......2006-06-30

After several years of photography and being frustrated with the results I was getting I finally decided that maybe I did need to read the manuals that came with the camera. After countless hours of trying to decipher what exactly they were trying to explain to me, it became clear that I needed something a little more "user friendly" that would still provide the necessary information to help me get the results I was looking for. After looking over several books I settled on Professional Techniques for the Wedding Photographer by George Schaub. I am not a wedding photographer by trade, in fact I have to be dragged kicking and screaming to a wedding (including my own). I found this book to be quite interesting as Mr. Schaub went through several lighting techniques that can be used not just for weddings but for all portraits. The book was written in a concise manner giving you the necessary theory behind lighting followed up with a real world example with diagrams of where to set the lights. After reading this book I still hate going to weddings and would rather go to the dentist than sit through a session with the new couple showing their wedding photos. But at least I understand how the photographer got the results they did and how I can recreate them to make me a better photographer.

5 out of 5 stars Great title for photographers.......2007-03-09

This title is a great addition to any photographer's library. If I ever need to find a contract or form to use, this book has it. If it doesn't have it, it does have something similar to what I need so I can adjust it to work for me.

Speaking of working for me...the CD included with this title is a God send. It has all the forms from the book in RTF and Word form. This is nice because you can just go add names or make edits as you see fit without having to retype everything on a page.

It also explains thing you need for each form if you want to create your own (such as basic guidelines for a consent form).

I'd recommend this book to any photographer without an attorney or many years of business/legal experience.

5 out of 5 stars How to Protect Yourself as a Professional Photographer.......2007-01-09

This book contains forms covering every area of photography. A must-have for everyone who makes or wants to make a living as a photographer.
